offer刚刚签,还没inspection. 突然在public record发现这个房子和周围的几个房子
都卖的是quitclaim deed (with quitclaim coveants)。这个一定要是wanrranty
deed才行吧
不过,我知道那个地方有大片的conservation land,还有很多easement
请教
quitclaim deed

卖家有两个相邻的房子,我们买了一个,收到的quitclaim deed上,卖家把整块地都签
进去了。我估计可能原来他买了一个房子(就是我们买的)有一大块地,后来在旁边又
建了一个(他现在住的)。中间有个分界线,也分别有尺寸面积。这次签quitclaim
deed的时候,竟然犯了这种错误。

怎么我的agent跟我说即使签署了 quitclaim deed 老婆、老公还是各自拥有50%. 只是
在买房的时候如果你结婚了只用其中一人的名字来贷款,另一方必须签署quitclaim
deed,但这并不影响对房对房产50%的要求权。

close的时候你应该看到quitclaim并签字,很奇怪为什么没有quitclaim deed签字。你
问问你的loan officer。
你现在可以再叫之前这个律师重新做一份deed,如果是MD的话费用在200左右。
如果你不满意这个律师,可以再请别的律师。

我婚姻状态搞错,
地的经纬度后面少个 E
房子地址搞错。 估计卖方律师用以前模板, 把以前别人地址写为现在房子地址, 后
面 paste 了现在房子的方位范围描述。
还好mortgage deed 和 title insurance 没错。 奇怪的是这insurance 好像也不看
quitclaim deed 就给你保了, 他们好像只看mortgage deed.
买个房子感慨万千, 这律师都是比较高的阶层了, 咋办事这么粗糙, 素质修养那么
差呢。

your husband, as the grantor, needs to execute a "quitclaim deed" to convey
the property interest to both you and him as the grantees.
fill out two forms and have the deed recorded at the County Recorder.

this has nothing to do with the lender of your house, because a quitclaim
deed doesn't transfer mortgage debt.

I haven't seen any proof that the house was purchased with cash. The deed
shown online was a quitclaim deed, allowing Liu Juhua to have all of the
right to the house. But it doesn't contain anything about date and price
and payment method of the original purchase.

卖家还价了4页纸的附加条款,看不懂中,
第一个:
title to the property shall be conveyed by either special warranty deed or
quit claim deed or an equivalent thereof, with convenants against the acts
of grantor. if hte title of the property is currently held as leasehold
interest seller will not transfer into a fee simple interest.

No big deal, just find a real estate lawyer to file a quitclaim.
Unless your got more than 2 millions, you don't even need to worry about
estate tax.

Cancel? He can't claim homestead after moving out. You need to do that!
Quitclaim a homestead (get a lawyer if you don't know how to do it) and ask
your town for abatement. No big deal, just common mistakes of a first-time
home owner.

谢谢回答啊,你说的对,title是最根本的问题。
刚刚问了我的mortgage broker,说是lender‘s title company(也就是broker找的
title company)也不会接受修改的quitclaim deed,唯一的办法就是wife在sales
contract上签字,以及closing的时候在该签字的文件上签字,这样title company才会
接受。
对啊,seller这样搞,就算不卖给我们,别人也没办法买啊。
就是不明白seller为啥死活不愿意让wife签字。

最近买了房子,今天收到title document source来信,说寄大概$50支票,
“Your (homeowner real estate document package) and your Declaration of
Homestead will be sent to you in about 25 working days. Your package will
include your blank ready to use Grant Deed, and Quitclaim Deed and a fully
prepared Declaration of Homestead. Declaration of Homestead is not required,
it is only there for your protection if you choose to have one".
请问大家买房子后有没有要这东西?多谢。

我来讲讲,觉得有用请发包子。
美国境内买卖房产都用deed。你也可以把Deed叫title,不过似乎车产证叫title的比较
多。Deed表示一个房地产的所有权的转移,具有法律效力,上面会写清楚某某房地产某
年某月某日由谁谁转交给谁谁,卖价多少,税多少等等各种详细交易信息。Deed有很多
种,比如grant deed, quitclaim deed和warranty deed。一般Warranty deed用得最多
,这是因为warranty deed是一种上了保险的Deed,如果房地产交易之后,你钱都已经
付了,卖家已经跑路不知去向,而你却发现这个房地产的所有权有问题,比如卖家曾经
偷偷把这个房产抵押给银行来贷款,又或者卖家欠了很多税没交,或者这个房子卖家没
有100%的所有权根本不能卖之类的纠纷,保险公司会出马帮你搞定,如果搞不定,保险
公司会全额赔付你的损失。

理所當然的中式思維,放在美國有時是覺得不可思議。我們一般說的deed主要有grant,
warranty, quitclaim三種,不管哪一種,不是不能辦,是邏輯不通無法辦,護照,駕
照是政府發的,房子是你買後去登記的,應該沒有人會為了重新登記,自己再grant一
次給自己吧。

须要贷款公司的指定律师。非常后悔选这家公司。
律师close 前也没把quitclaim deed 给我看。close后也没收到deed. 现在已经住进一
段时间了,到town的网上一看, 律师竟然把错的deed给 record 了。
现在让他改, 他不是说他不在office, 就是不回邮件。
应该怎么办? 求建议.

这个不需要找title公司。如果是换新Owner或者加个owner,找个公证员原来owner签个
grant deed, 如果是一个以上中的一个owner要退出,也是去公证一个quitclaim deed
。公证完要去county 那里record一下就生效了。

你这是要离婚啊,婚后买的房default就是community asset. 除非当初你签了
quitclaim. community asset does not need any proof. If you claim that's your
sole property, then you need some kind of proof. If the house was bought
before your marriage, then it make sense to do it.

你们是不明白“QuitClaim deed”到底是什么意思吧。 Quit Claim是放弃有关房产的
权益,受益人必须已经是房产的权益人之一才行。这个文书收的印花税是按照房产当时
估价算的,和房产交易价格是毫无关系。这个文书顶多证明方舟子和妻子在之前某个时
候获得了这个房产,在2013年的时候方舟子放弃了自己那部分权益,刘菊花现在是房产
的唯一拥有者,在文书生效时,房产估价为$670k。 这和证明方舟子花了67万买房子是
完全两码事。
而且博文里没有驾照和指纹。要是博主能搞到驾照,那不就能直接证明签名到底是不是
方舟子的,还绕那么大个圈子干什么。
