最近据公司内部可靠消息，总公司要把我所在的小公司卖掉，或者裁员相当一部分人。
我刚开始来公司的时候办的是EB3，09年140 已经批下来了。后来觉得排期遥遥无期，
想办法让公司帮我办EB2，现在广告打完了，刚刚开始办perm。本来以为两年之内等排
起一到就能递上485，priority date 07年10月。
谁知道我现在所在的分公司因为总是亏钱很有可能被卖掉，我H1-B,EB3,EB2 全部都是
这个分公司作为sponsor帮我申请的。
现在有两种可能：
1。我被裁员裁掉了，我明年10月6年H1B到期，凭借EB3早已经批下来的140 可以
transfer到新公司，renew H1-B 3年。不知道可不可以保住原来priority date,重新办
绿卡。
2。我所在的子公司被卖了，并入新的公司，名字一定改了。这时候之前EB3办下来的
140，还有eb2已经下来的perm还有效吗？可不可以保住原来priority date？
这么多复杂的问题，我也一直没有头绪。

transferable as long as the jobs are similar. |

发帖数: 3027 | 5 For sure you will keep your priority date of the EB-3. Immigration has
official document about this.
If you are laid off, you will have to start a new PERM with a new company.
If you are still in the same small company sold out, you need to consult an
attorney to see whether you need to file a new PERM.
Anyway, you will have your old priority date, and whether having to file a
new PERM again will not affect how soon you will get your GC, since you
still have to wait for a few years before being able to file I-485. |
