我是07年大潮中递的140和485，结婚是2007年12月，这么说我门就没法follow to join

As long as you get married before your 485 get approved, you can always file
for your spouse (even if you got green card already but havn't file for
your spouse yet).

酱紫也行阿！太好了。
那如果我被批的时候太太在中国，还能回来再file485么？如果可以的话，回来以什么
身份回来呢？（已经有h4 visa，但不知到还能不能用？）

发帖数: 3271 | 4 上面的解释不对，follow to join只适合配偶不在美国
如果配偶在美国有合法身份（如F1，B1），可在任何时候File 485 AOS
如果配偶在美国是H4, 身份在你485approve的同时失效，但有180天的Grace Period可
以呆在美国，只要在这段时间file 485既可。但是在EAD没下来前不能工作。

your 485 approval, she / he can stay in US for up to 180 days to file 485.

继续确认一下：
1。那么你说的配偶不再美国（follow to join）如何操作？具体的，如果主申请人的
gc已经approve了，配偶是H4，但不在美国，如何操作？
2。交了485还需要排期么？比如我现在如果是07／01／2007，排期到了，
老婆回不来，我批了，老婆随后交485，没披下来之前排期又回到了4／1／2007，
老婆的485会不会受影响？
小声说一句，我碰到的公司的律师都说follow to join，没有特指在不在美国。

long as 1 year even your PD is current. During the time your spouse CANNOT
come to US! 直接File 485, 前面说了，即使你老婆H4因你的绿卡批准失效，也有180
天的Grace Period File 485,其间呆在美国合法，只不过不能工作。

非常感谢！
其实我不是说律师的建议要出境，而是我老婆现在不在美国（刚回去几天），
回来的机票是几个月以后的，本人是7／19号的pd，11月份的排期不出意外总能赶上，
所以再纠结要不要买机票回来，所以有那么些困惑。
这么说最好还是提前回来（10月底），酱紫比较快也比较方便，对吧？

to USA on H4 because it is automatically terminated. She has to follow to
join and it may take months during which she has to wait in China.
