another I-140 petition classifying your case under EB-3. Current processing
time at USCIS for another I-140 is about 4-5 months (no premium processing
available for a 2nd I-140). This would not affect the EB-2 I-140 approval
that you already have. Once the EB-3 I-140 is approved and if your priority
date is current under the EB-3 category, then we would request USCIS to
substitute the underlying I-140 of your pending I-485 applications.

BTW, I will submit my EB3 I-140 (PD 2012/8/1) on March 1st under my lawyer's
guidance and help.

Bernsen & Loewy, LLP)
Question:If the EB3 is declined, does Weiyi pop back into her position and
standing in the EB2 category or do we start over? We don’t want to lose
time.
Answer:Exactly, she will just continue on waiting for her EB-2 priority date
to become current and then file her adjustment of status application at
that time. Filing for the "downgrade" is not done at the expense of her EB-
2, that remains available to her if the EB-3 is unsuccessful.
