，目前在等新的EB2 140下来。 下面是HR关于不肯降级到EB3的回复 ， 第一条我没看
懂，是不是说eb3的140不能加急？第二条貌似在说降到EB3后再回eb2会很麻
烦？
The current I-140 filed on your behalf included the original PERM
application, filing another I-140 requesting EB-3 category would preclude
the 2nd I-140 to be filed via PP (premium processing). Therefore, no
adjudication within 5-15 days for a new I-140 filed requesting EB-3.
Furthermore, these duplicate filings are not handled as a priority by USCIS,
which means it can take up to one year+ based on USCIS’ current backlogs.
Please note a concurrent filed I-485 application would not be adjudicated
until the underlying I-140 was approved.
Another issue to consider is if your EB-2 priority date becomes current
before a 2nd I-140 petition requesting EB-3 category is adjudicated, you
will be stuck under EB-3 unless the company succeeds in having USCIS then
link the EB-2 case and remove the EB-3 case. The overall process is
burdensome and time consuming and not always successful from an
administrative point of view. Therefore, the company will not pursue filing
another I-140 on your behalf. |

date, 可能还是慢慢等eb2比较好？ |

发帖数: 916 | 3 第一条，降级的140因为没有perm原件，直接PP确实容易被拒。但一般交上去等一周拿
到receipt之后再PP就好。一次PP不行就两次。绝大多数都可以PP。即便不能PP，普通
处理时间也就是6-8个月，不至于1+年。
第二条，降级140批了之后，你自己就可以在2,3之间自用relink，根本不用通过公司或
者律师。 |

发帖数: 6509 | 5 其实第二条只是提前给你的预防针，因为这个目前是灰色地带，万一以后改成只允许存
在一个I-140，你去找他们麻烦就不好了。
当前可以不必理会，以后规则改了再说吧 |
