昨天写信问律师是否需要降级。律师今早回信说是个好机会，但是有些风险就是降级
EB3后，按我的PD，未必会比EB2更早拿卡。以下是律师原话
NOTE: There are potential risks with two I-140 filings. For example, the
Visa Bulletin changes often and it is possible that keeping the 2nd
Preference I-140 filing instead of filing a new 3rd Preference filing will
result in a green card being issued sooner. It is also uncertain, in such
event, if you can revert back to the original 2nd Preference filing or, in
such event, whether the employer will be allowed to file a "third” I-140
application on your behalf.
但是律师最后谨慎小心的又说根据他们以往的经验，file a second I-140 in the "
3rd Preference" Category 是个好机会.
我看到律师提到的风险有个疑问，如果降级，假如eb2排期先到我的PD，我不可以递交
485吗？
看最新的VB，eb2的第二排期才到13年10月份，eb3的第二排气已经超过我的PD了，是不
是说下一个财年eb3PD在15年9月1号之前的可以交表了？ |

在版里总看见说双飞，不明白。
另外，如果移民局不honor第二排期，那我的pd就没入门，是应该等等还是现在就降级？

发帖数: 2760 | 7 双飞指的是同时交降级交 140 和 485.
PD 没入门的时候不用降级，只要二排Honor了，你可以选 PP 140 +485， 或者常规降
级 140+485，都是没有问题的，至于是否PP，根据个人的喜好。
PP的好处，
1.假如一排和二排隔的很近，你的140不批的情况下，那么你的485当然不会批。即使一
排C了，你的485也会一直pending！但是如果你PP 140了，140批了，有可能就马上处理
你的485，马上绿。
2.假如你突然自己换了工作，140没批，万一来个rfe，公司不帮你处理，所有的工作前
功尽弃。
3. PP的坏处是多花钱。
至于何时PP，有的人直接PP，有的人等拿到了140的receipt， 再PP，都没有什么问题！
只要你降级了，二排honor，提交了485，在485 pending的情况下，不管你的140是否PP
，都不会影响你拿EAD+AP。
