她本来是F1， 4月和我一起交485(我是EB2), 然后家里有事5月申请 emergency AP 回
国，然后 emergency AP 入境。 我们 EAD 和 AP （这个因为离境好像也作废了） 都
还没有拿到。
她们学校律师说有下面三个选择, 不过学校希望能赶上8月19之前， 请问该怎么选呀？
1. File an initial H-1b (via consular processing) – This would require
go abroad and re-enter on H-1b;
2. File a change of status from AOS to H-1b;
a. This may prompt a “request for evidence” response from USCIS. We
need to be prepared to respond;
3. Wait for EAD. At this time EAD’s are taking approximately 3-5
months. At this time USCIS is processing applications filed in February 2019.
她现在应该已经没有 F1 身份， 只有 AOS 了吧？
选择 1 或者 2 会把 485 废掉吗？
选择 2 提到的 RFE 是因为她现在没有 F1 身份了吗？ |

回复。
The safest route for your spouse would be to wait for the EAD from the I-485
filing to be approved and for her to work using that. Filing an in-country
change of status is likely not possible, your spouse is not in a valid non-
immigrant status as she was admitted to the United States as a parolee
pending a green card application. As such, a consular petition is the only
choice. Applying for an H-1B visa at a consulate abroad with a I-485 pending
will likely result in USCIS treating the pending I-485 as abandoned. She
would then need to re-file the green card application (assuming the priority
date is current).
For this reason it would likely be best if your spouse simply waited for the
EAD, this will provide work authorization until she receives her green card

By the way, because your wife got an emergency AP before leaving the US, I
think her I-131 petition at a USCIS service center is still valid. Also it
takes much longer to get EAD/AP approval at NBC than other USCIS service
center.

可惜，好像就是NBC （MSC开头的receipt）。

发帖数: 4965 | 8 看网友们的报告，NBC的EAD/AP要等6个月或更长的时间。要想8月拿EAD卡基本上只能试
试Expedite Request这条路。

发帖数: 3509 | 9 交485时不是H1B身份的，不能从AOS转到H1B，因为AOS本身不是身份。又是个胡扯的律
师。
没有AP出境去搞H1B签证，485就废了。
expedited EAD是唯一一条路。搞不定的话宁愿放弃这份工作，也不差这几个钱吧。 |

一般人想的应该都是快点拿卡，而不是放弃已经等了3个月的485去做份学校的工作。

发帖数: 2 | 13 绿的时间本来就不可控，几个月到一两年都有，相比之下三个月还好。
我自己觉得职业更重要，如果工作机会非常好的话。绿无非就是早晚几个月的事，但很
好的职业机会错过一个，可能要等好几年，而且少赚很多钱 :)
