发帖数: 148 | 2 Regarding # of full time researchers, it is a little vague in the
instructions. From what I understand, USCIS actually requires 3 additional
full time researchers not including yourself.
I am not sure how you can get around this if you以分公司的名义申请 and only
you and your boss are researchers. However, if your boss is willing to help
you out, you can list all researchers in US and UK. To be safe, in the
letter you can present in a vague way such as: At xxx (note here the company
name should be the main organization name not something like xxx USA), we
have 9 full time researchers who are striving to ......Below is a list of
these researchers with more details.
Name Title Research area
Boss xxx xxxxxx
You xxx xxxxxx
and other 7.
Just a thought. Consult your attorney if your company has one. But it really
depends on how much your boss wants to help you. This type of letter is
indeed a piece of cake if he wants to help. It does not cause any legal
issues.

In such case, I would need the CEO from UK to file the petition letter,
right? Can I ask my boss to file it?
I had another thought:
The R&D department has totally 8 people, 6 in UK and 2 in US. We are working
closely via weekly teleconference and sample exchanges.
My boss is going to file the petition.The table will be

Boss xxx xxxxxx US
You xxx xxxxxx US
and other 7. UK

发帖数: 148 | 4 I looked through I-140 instructions again (EB1b in section1 on page1). The
main point is the petitioner has to be a US employer. So your boss will need
to sign all the documents. In this letter, I would suggest not to mention
the location where the engineers are to avoid to draw IO's attention on this
matter. Try to keep it as vague as possible.
By the way, in my earlier post, I was wrong when I said USCIS requires 3
additional researchers not including you. 3 in total including you is the
minimum requirement.
