2008, renewed H-1B for 3 years.
2010, entered US using AP, got I-94 for AP, and so terminated H-1B and
became AOS.
2011, got H-1B renew from October 2011 to September 2014.
Since H-1B extension is granted, I should come back to H-1B from AOS. My
question is, exactly at what time does the reinstate happen? The new start
date (a date in October 2011), the notice date on I-797A (a date in June
2011), or some other date? Is there anything I need to do on my side for

possibly your H1 clock never stops. You don't need to do anything, but to
wait for your 485 approval and the arrival of your green card.

where did you get "The new start date (a date in October 2011)"? | c***o 发帖数: 131 | 4 On the approval notice I-797A, the "Notice Date" is 6/21/2011. The H-1B is
valid from 10/1/2011 to 9/10/2014.
I am just wondering from which date (6/21/2011 or 10/1/2011) is my H-1B
reinstated.

AOS since on the I-94 card I got on that day, the status is "AOS". That's

renew your H1 within US, otherwise, as what I was told or what I understand,
officially there's no way to go from AOS to H1 within US, as AOS is an
immigrant status, but H1 is a non-immigrant status. You'd have to go to a
third country to apply for H1 visa stamp. That would be the case for the
people who have used their EADs, that's a hard AOS status.
As to your H1 reinstatement date, your new H1 will be from Oct 1, as stated
on that form. Well, what are you now in exactly? It may not be a hard AOS,
but a unstopped H1. It is a gray area. I doubt if you can count the duration
from your AP changed AOS to Oct 1 out of your H1 clock time.

your recent entry with AP doesn't affect your H1B status, practically.
