下面是律师的解释，因为没有在网上看见别人有这个问题，现在我都怀疑律师了。
The EB-3 I-140 is still pending, and these applications are typically
adjudicated within 6 to 8 months from when they are filed. You would only
benefit from the EB-3 I-140 once it has been approved. Unfortunately, it is
not clear under what circumstances USCIS would "premium processing upgrade"
a second I-140 filing when filed without the original PERM. Some of our
clients have been successful in "upgrading" their second I-140 to premium
processing, but not all such requests are granted. Other than filing
subsequent requests, there is no known mechanism for increasing your chances
of a successful premium processing upgrade.
Under regular processing, I-140 petitions are typically adjudicated within 6
to 8 months. However, if the premium processing request were to be
rejected, we do have the option of resubmitting it. Please note, each
subsequent premium processing upgrade request would be an additional $300 (
our legal fee of $250, and incidental costs of $50). We will continue to
monitor this matter and will contact you as soon as we receive any new
information.
