I worked with H1-B for a company and was laid off in this March.I filed H4
petition before the H1-B expires and got the approval in May.
Meanwhile I found a new job in April. With no knowledge of the ongoing H-4
status at that time, my current employer filed a form I129 to transfer my
previous H1-B in May (before I got H4 approval). I then got the mail that

解没有问题的话。而且，h1b transfer 是不需要approve德，只需要你file，对方收到
就可以上班了。 |

你这是H-1B＝》H-4＝》H-1B，标准的转换身份（Change of Status），
你现在是H-4身份，在H-4＝》H-1B批准之前，你是不能上班的。
你为什么向公司隐瞒你申请H-4的事实？
让公司办一个H-4＝》H-1B的加急申请很快的。
从六月到十月，公司是非法雇佣，你是非法工作（H-4是不能工作的）。
你自己给自己挖了一个坑，然后跳进去了。

俺重没隐瞒任何东西。
新公司一直知道我在旧H1B expire 之前要file H4的，所有的信息我都立即转发他们。
只是他们当时非常忙，一直拖着没能在旧H1B expire 之前file H1B transfer。等他们
file时我的H4申请是在pending状态，所以他们就直接file H1B transfer了。
当时说反正H1B申请的reicept收到就可以工作了。是不是非法还得等看看uscis的
denial letter怎么个说法。
真是被折腾够了。

When you filed new H1B petition, did you include any material
related to H4 petition?
I am H1=>H4. If I get a job, I'll face the same problem.
Can you please share what USCIS explains when you receive the mail? |

至于H1b-H4-H1b是属于transfer还是new petition的问题，我觉得没有那么简单 （我
本人非常感谢版主mandman的耐心解答）可是版主的理解和我们公司的律师认为的就是
不一样，我的情况是H1b-F1-H1b，公司的律师就是按transfer在办。
我觉得精华区的这篇文章很解决问题。如果我说的不对，欢迎回复。

1. I did send my H4 approval doc to the new employer, but that's after they
file the H1B petition. Actually I don't think they have any H4 related
material when they file.

到office能怎么个解决法，是指当面appeal? 不知道有没有这回事。

这样快有效！！
对了收到信后，别忘了来这update，让大伙明白原因到底是什么。
