离职140肯定没了
是指PD还在,以前雇主如果非要revoke的话PD也没了，排期白排

外籍劳工获准I-140申请后所得到的优先日期，是决定其等候移民签证号码的重要根据
。优先权日将会一直有效，除非因签证欺诈、伪造材料等行为而被撤销I-140批准。该
规定将会增强已获准的I-140签证申请人员在工作上的可变动性。这也将会提高获准的I
-140签证申请人员在升职、更换雇主以及追求其他雇佣机会方面的能力，且不会担心因
此丢掉他们在移民签证中的排期位置。

withdrawn when a labor certification is invalidated, the petitioner dies/
business is closed or the petitioning employer withdraws the petition (most
common). Under the current USCIS practice, withdrawal of an I-140 by the
employer generally does not affect the sponsored employee’s ability to
retain their priority date but, currently, revocation of an I-140 impacts
the ability of an H-1B worker to obtain H-1B extensions.
The new final rule amends the regulations so that EB-1, EB-2 and EB-3
immigrant visa petitions that have been approved for 180 days or more would
no longer be automatically revoked based only on withdrawal by the
sponsoring employer or termination of the petitioner’s business. I-140s can
still be revoked by the government based on fraud, material
misrepresentation, invalidation or revocation of a labor certification or
material USCIS error. As a result, an eligible I-140 petition can be used to
retain the priority date with a subsequent I-140 petition, obtain H-1B
extensions with subsequent employer and obtain job portability.

h1b的renew。
新的政策是180天后雇主无法取消1-140并且也不会自动revoke，更不会影响h1b的
review。
那如果不到180天还是会自动revoke，那这样看我的140早就自动revoke了，无论新政策
还是旧的政策。

1月17号起，新政策生效
PD永远保留，与 140批准日期/485的RD日期 之一超过180天，140就永远有效。

新政策跟pd关系不大，以前也是可以保留pd的。
新政策主要是关于跳槽保留i140，现在180天后跳槽可以永远保留i140，用来renew h1b
和配偶ead。但是如果要申请绿卡还是要重新走perm。
总之好处就是180天后可以永远在美国工作了 |

就算你离职了，当初办理的手续没有问题的话，140可以一直有效，因为你可以在未来
再回到这个公司同一个职位不需要重新办理140啊，那么超过180天后雇主没有权力撤销
了，这个140就彻底终身有效，就是你没办法拿这个办485而已

假如新工作跟旧工作性质不太一样，甚至是转行了，旧的PD也还能用么？
