(大纪元记者吴安妮编译报导)美国上诉法院2月27日(周四)裁定,加州一所学校制止
学生在五月五日节穿着印有美国国旗的T恤衫的行为,并没有侵犯他们的公民权。
“Cinco de Mayo”是西班牙文“五月五日”的意思,这是美裔墨西哥人的重要节日,
庆祝在一百多年前墨西哥以寡击众击退法国的入侵(1862年,将近150年前)。
根据上诉法院,学校的这种做法,是为了保护学生们在种族紧张的气氛下的安全。
CNN报导,美国联邦第九巡回上诉法院的法官们在他们的案件结词中说: “虽然种族的
争论和紧张依然存在,但学校先见之明的行动避免了口角的发生。”
学校官员因担心暴力使学校活动遭到破坏,因此“他们的反应是完全考虑周遭环境因素
而作出的,”法官们说。
该案件可追溯到2010年5月5日,加利福尼亚州Morgan Hill市的Live Oak
高中校长,要求一群穿着印有美国国旗的T恤衫的学生,把他们的衬衫由内反过来穿或
者脱掉身上的T恤。这群学生们拒绝了校长提出的要求,之后以言论自由,平等保护和
正当程序权利受到侵犯为由,将学校和两名学校管理人员告上法庭。
法官表示,公民权案件,迫使他们很艰难地权衡其优先因素:即学生的言论自由权和学

Appeals court justifies Morgan Hill school's dress code
High school officials in Morgan Hill had reason to fear ethnic violence, and
therefore did not violate freedom of speech when they refused to let
students wear American flags on their shirts on Cinco de Mayo, a federal
appeals court ruled Thursday.
Students have a right to free expression in school, but officials can impose
restrictions to prevent threatened disruptions, the Ninth U.S. Circuit
Court of Appeals in San Francisco said. The court said the high school
principal had reason for concern after hearing reports of a potential clash
on a campus with a history of ethnic violence.
The case arose from Live Oak High School's observance of the annual Mexican
holiday on May 5, 2010. The year before, a group of Mexican American
students had observed the school-sanctioned holiday by walking around campus
with a Mexican flag. Some Anglo students responded by hoisting a makeshift
American flag up a tree, chanting "USA" and exchanging threats and
profanities with the Latino youths.
On the 2010 holiday, the court said, several Anglo students wore shirts that
showed the U.S. flag, and three of them were confronted by other students
in the morning. Warned by students from both ethnic groups of potential
problems, the principal, Nick Boden, told the youths to either turn their
shirts inside out or go home for the day. Two chose to go home and were
given excused absences, without punishment, while others complied with the
order.
The lawsuit by three students and their parents relied on a 1969 U.S.
Supreme Court ruling that upheld students' right to wear black armbands to
class in a silent protest against the Vietnam War. But the appeals court
said the 1969 decision allowed schools to limit student expression to avoid
the type of disruptions that seemed likely in this case.
The Morgan Hill school's actions "were tailored to avert violence and
focused on student safety," Judge Margaret McKeown said in the 3-0 ruling,
which upheld a federal judge's decision.
The students also claimed discrimination because the school had prevented
them from displaying American flags while allowing other students to wear
the colors of the Mexican flag on their shirts. But McKeown said the school
had a "viewpoint-neutral reason - student safety."
A lawyer for the youths disputed the court's reasoning and said they would
appeal the ruling.
"If they were so concerned about violence, why didn't they cancel the
celebration?" asked Robert Muise, an attorney with the American Freedom Law
Center in Michigan. He called school officials' claims of impending violence
"utter nonsense" and said the ruling would abolish students' "
constitutional right to freedom of speech."

其实就是在加州的中部, 农村的地方, 美国籍的墨西哥人穿美国国旗抗议非法墨西
哥人。
墨西哥人内斗而已。
