前几天我刚刚处理过类似的事情
最后我们的调查结果是孩子不小心被另外一个孩子打到的，不是老师打小孩
而且小孩子自己也觉得是不小心碰到的
然后我们还要通知小孩子家长，说明这件事情调查结果。

1. 小孩上的是个私立学校
2. 打人的老师说他不小心打的，小孩手里有个球，老师说他去打球不小心打到脸上了
3. 小孩被打了后，流鼻血，并说头晕，当时去了急诊。朋友当天去跟学校交涉，要求
赔偿医疗费，学校说不赔，因为老师不是故意的。朋友英语不好，又比较激动，双方交
流比较困难。
4. 朋友打算请律师，但不知道到哪找律师，以及找什么样的律师
5. 朋友小孩还说那打人的老师跟别的学生说“ do not speak to that chinese" 的话
， 所以朋友觉得老师歧视他们孩子，也认为那老师就是故意打的 |

孩子父母也不要去，先尽快找到律师，让律师去交涉，自己尽量少和对方说
关于找什么样的律师，可以试试问一下你们当地的bar association，看看他们有没有
建议
另外，开始找其它的学校吧 |

Can his kid speak good English? Did the kid behave well at school?
If the teacher did it on purpose, he should be fired. If not, let it go.

还有孩子都五年级了，在学校表现如何，家长怎么会不知道？还有这个老师之前有没有
歧视，孩子在家有没有提过，家长也不可能完全不知道。
个人觉得外人很难说是有意还是无意打的，就好象比赛中是有意还是无意犯规一样。只
有当事人清楚。这事情首先不能针对学校，如果孩子很清楚老师是有意打他，并且一直
有歧视，当然要和学校反映。如果学校的处理你不满意，只能换学校。找帮手去学校闹
只能适得其反。实在有钱有时间就请律师。 |

It is very often to have bloody nose in the gym. A hit by the ball will do.
But if the kid has a high degree concussion, that will be a different
story. You can hire a forensic expert to determine this. Is this worth it?

Documentations:
1. take pictures or copies of the following things, your kids's wound, the
doctor's diagnostic documents. And any other images that support your son
was physically injured.
2. video tape：1) your kids' description of the situation in a scared manner
, tears, hardly complete one sentence etc. any other behavior changes that
can support that your kids were scared by the teacher's rude physical
torture on your son. 2) visit your kids' classmates . let them tell what
caused your son's injury, what did the teacher said. 3) ask your son's
classmates whether this teacher had violent behaviors (both verbally or
physically) to other students.
3. The school is liable to any injuries that any student suffered during his
school time. even if the student fall down on to the ground resulting in
injury by himself, the school is responsible for that cost! The private
school is demanded to have liability insurance to get a license!
You can write a formal letter to the school, cc to the state licensure
department, requiring their accident insurance information. In your etter
you need require the representative (school principle or director ) to sign
the letter acknowledge that the school received the letter. You need video
tape the moment you hand over the letter to them and explained to them that
you are formally inquiry for the liability insurance according to the code
NO.xxx (google search for lencensure code for private school in your state).
Require them provide the information by the end of the school day. (
specific time and date). Tell them if you don’t get the information, You
are going to take further action. And this letter is partial of your
documentation for future use. ( when talk to the school, you need keep
calm and firm!, keep logic! Because it is going to be used for the court.
You need display yourself as well educated, decent gentleman or lady, this
will win the judge’s respect. Besides, your calm and firm statement will
scare the school also, They will immediately realize that they cannot full
you around any more!
4. With all the documents mentioned above, you don't need a Lawyer to fight,
you will scare the hell out of the school and the PE teacher .
5. To further sue the teacher for discrimination, you will better off to
hire a lawyer under the situation that the PE teacher never physically
tortured the other students.

如果有歧视不会只有一件事。更不会当着那么多孩子打这个孩子。那个老师得有多傻？

他不传，老师去拍球，一不小心拍到脸了。我觉得这个可能性最大。
老师拍错了，孩子受伤，学校该付医药费。不管老师是否故意。老师如果没给孩子马上
包扎，是很过分。但是不知道鼻血是马上出来还是过一会才出来，还有就是多少血。
感觉国内刚来的朋友去闹的时候是比较激动的，有点象国内闹事的，要别人认错。这个
学校是不会认错的。尤其什么歧视之类。那个罪就大了。
好好讲医药费应该要的回来的。 |

不过听下来这事还难保怎么回事。所以录像证词要小心，孩子可能被吓到说谎，留下录
像也许不是好事。问同学也不要留录像了。要录像必须跟别人的父母讲清楚，不然也算
侵犯权利了。
