公司答应工作后马上申请绿卡。上周刚签完OFFER,这周给我发了一份信叫做“
AGREEMENT FOR REIMBURSEMENT OF IMMIGRATION EXPENSES",大意是如果以后离职可能
要还公司申请绿卡的钱。
好象是如果要避免还钱,绿卡下来两年之后都必须为公司工作。 这种要求常见/合理吗?
而且下面第二段里,离职还不光是主动辞职:“due to voluntary resignation or
discharge for cause (other than poor performance).”
这个discharge for cause什么意思?如果公司裁人我把裁掉,也要还钱吗?这些条款
好像太TOUGH了。各位给说说
下面是主要内容:
PERIOD OF TIME THAT EMPLOYEE HAS REIMBURSEMENT OBLIGATIONS:
The Employee will be obligated to reimburse XXX for Immigration Expenses if
he or she terminates employment after work has _____ begun on Employee's
permanent residency visa and before the date two years after the Employee's
"permanent residency visa" is issued or the "Issue Date"_____.
DEFINITION OF "TERMINATES EMPLOYMENT" FOR THIS AGREEMENT:
Under this Agreement, the Employee terminates employment when the Employee
ceases to be employed by XXX or any direct or indirect majority owned
subsidiary of XXX , due to voluntary resignation or discharge for cause (
other than poor performance).
DEFINITION OF "IMMIGRATION EXPENSES" FOR THIS AGREEMENT:
Immigration Expenses are expenses incurred by XXX after March 1, 1993 in
connection with obtaining the Employee's and the Employee's family's
permanent residency visa. Immigration Expenses will include, but not be
limited to fees and disbursements paid to outside law firms, filing fees,
fees for educational equivalency evaluations, and for services rendered by
XXX's Legal Department, any standard fees or debits if it is the Legal
Department's standard practice to charge applicable XXX cost centers for the
type of services rendered on Employee's behalf. Immigration Expenses will
NOT include payment of any kind for any activity related to filing an
application for labor certification, including payment of attorneys’ fees
and other costs.
