首先，所谓conflict of interest,在judicial disqualification程序上有两种路径，
要么法官recuse sua sponte,要么一方上motion。lying trump要是觉得在法律上这个
coi成立，就不用whine了，上一个motion就算是denied了也是上诉的最佳理由，end of
story.
其次，所谓COI的理由成不成立？或许lying trump 这个理由可以骗poorly educated的
达克，骗不了其他人。
原因如下
Judicial disqualification规定主要在28 usc 455. 455a实践中容易一些，455b举证
责任非常严苛，除非有compelling evidence证明特定的impartiality，否则压根没戏。
那么455a怎么规定的？
Any justice, judge, or magistrate judge of the United States shall
disqualify himself in any proceeding in which his impartiality might
reasonably be questioned.
Aha，达克会说，这就是coi啊，你看lying trump要造墙反墨，那个法官又是那啥组织
的，你看COI了！我们尊敬爱戴的lying trump就说，因为这个所以有inherent coi.
Well...
（1）判断的标准
it is with reference to the ‘well- informed, thoughtful and objective
observer, rather than the hypersensitive, cynical and suspicious person’
that the objective standard is currently established. Andrade v. Chojnacki,
338 F.3d 448, 462 (5th Cir. 2003)
在MANN v. THALACKER 246 F.3d 1092 (8th Cir. 2001)中，第8巡回法院in making
this inquiry, we of course presume the honesty and integrity of those
serving as judges. 在这一原则下，其判定法官幼年的sexual abuse history不能成
为recuse from presiding over sexual abuse crime的理由。
所谓父母是墨西哥人，以及人是什么组织的成员，根本通不过455a的reasonable test.
(2) 利益方个人制造的coi
就算lying trump的legal team跨越了455a的举证责任,arguendo,那么接下来的门槛是
Parties cannot be allowed to create the basis for recusal by their own
deliberate actions. To hold otherwise would encourage inappropriate "judge
shopping." It would invite litigants to test the waters with a particular
judge and then to take steps to create recusal grounds if the waters proved
uncomfortably hot. United States v. Owens, 902 F.2d 1154, 1156 (1990).
想跨越这个hurdle,又是一个uphill battle
（3）结论
lying trump一定从他律师那收到类似的memo了，所谓recusal在法律上如果站得住脚，
那么在法律上早就解决了。Lying trump知道自己的complaint完全在法律上没有依据，
才采取欺骗达克支持者，人身攻击的方式。 | M*******5
