发帖数: 33 | 1 I started to work for company A at the end of February and my h1b with this
company started from March 15th. I was laid off on June 15th. The
immigration department told me that my h1b status would be invalid
immediately therefore I submitted an online application for change of status
to B2 on June 17th. I mailed my supporting document to Vermont Center about
a week after June 17th. My B2 application is in initial review status as I
checked today online.
I accepted a job offer on August 23rd from company B and they are going to
sponsor H1b for me. I am afraid that my B2 application will have a decision
in couple of weeks and I don't know how it will affect my H1b application.
Specifically, my questions are:
1. If my B2 application is not approved, and company B has not filed my H1b
application, can they still file it?
2. If my B2 application is approved before company B files my H1b, can they
still file it?
3. If my B2 application is pending before company B file my H1b, but the
decision for B2 is made before my H1b decision, will it(approve or not)
affect my H1b application?
4. If my B2 decision is made after my H1b got approved, will it(approve or
not) affect my H1b application?
5. Do I need to withdraw my B2 application?
6. Am I qualify for H1b transfer?( I received my last paycheck from company
A on August 15th)
7. Can I use premium process to apply for H1b?
My biggest concern is failing to get B2 approved, and the decision is made
before company B files H1b application. What is the best way to handle my
