包括了，里面也没说地点范围。这是怎么回事，正常吗？到时候如果laid off了，这个
要求还在吗？如果跳槽，是不是就得在另外行业找工作了？

previous employer cannot show what you are doing is exactly what you worked
before, they will lose the case. So most cases, employer will not go to the
court because they know they are going to lose almost sure. Also, the judge
usually shows sympathy to employees. So this is why company does not file
lawsuits for non-competition unless you are a CEO who knows all company's
secrets.

内不得参与任何与本公司有利益冲突的工作（的确是“与本公司有利益冲突”，定义非
常宽泛，首先是“整个公司”，不是我的DEPARTMENT，公司做的东西太多了；其次，没
有限定具体某一类型的工作）。
我之前的OFFER LETTER里并没有这一项。所以想问一下大家的OFFER LETTER里是否有这
个？如果有的话，是否也是没有具体定义的霸王条款？有没有人因为这种条款找过律师
咨询过或者和公司协商修改条款过？

当然，我现在工作的公司也没签这种AGREEMENT。您当时是您自己提出来的还是对方HR
提出来的？
据说这个AGREEMENG对于从大公司往小公司或者STARTUP跳的，公司才有可能起诉（但这
个公司自己就挺小的。。。）。现在的市场，公司人员变换这么大，公司没空走一个员
工起诉一个吧？您听说过有类似情况被起诉的？

I talked to a few employment law and labor law specialist. And have asked
the company to add a severance package to cover that one year when I would
be out of job because of this agreement if I am not discharged by cause.
But then here comes another problem. Even if they are willing to pay me

开住，所以想签一个分居协议。他们可能先分居一段，然后再决定怎么分财产和要不要
离婚。但是分居前，最好签个协议。
父母都是new york city 的resident,我想问问这个marital separation agreement到
底有多大的法律效应，是不是签的时候一定要把财产划分清楚？
我想让他们先分开，财产慢慢再讨论怎么分割，这样是不是行得通？是不是只要找个律
师，签个字，交到county clerk那里就行了？
还有，分居多久就算自动离婚了？
实在他们已经被互相折磨得不行了，但是都不想一下子彻底离了，所以只是想试试先分

clear. Maybe you can argue it's Oct 31, but it depends on when you moved in

的理解就是（至多）12月之内都不能在金融行业工作了啊。部分摘要如下：
“Competitive Activity” shall include ... being employed by ... any
investment adviser, investment manager, hedge fund, private or public
investment fund ...
想请教一下街上前辈都有这类条款吗？实际中具体是怎么操作的？难道我被公司fired
了，12个月之内也不能找新工作（Agreement中说会付base salary)。

按照拿到的这个non-competition agreement，无论什么原因离职，两年内不能做
trading相关工作，而且公司在付现有工资后可以禁止你为竞争者工作。
我未来还是想做quant，有机会试试trader。考虑到这么强的限制，手头这个offer似
乎没什么意思。毕竟数字也不算高。
板上考古，有人说这些条款看似很强，都是干打雷不下雨，一般员工没事。真是这样吗？
猎头建议找律师咨询，推荐的律师一小时接近一千。谁有比较好的选择？多谢了。 |
