，白人。值得注意的是这次活动亚裔团体里好像少了上次看到的不少南亚人。上次照片
里看到他们，他们还写文章说他们深肤色所以同情黑人。
去的黑人不多，值得注意的是黑人进一步分化了，那个女黑人活动家 Ty Black不仅没
有去，还反对了被他们批评。
媒体反应很低调，都客观简单报道。特别值得注意的是评论的稀缺。最多是在雅虎上，
然后再NPR上。这就是我们斗争的成果，否则他们很嚣张。现在看来，不会有什么很糟
糕的结局了。

人对华人游行的不满和要求的。这个律师大概是好心，但是被别人这样利用操纵就太幼
稚了。我来回答黑人，请孟律师转交给他们。
1） 白人杀黑人不用负责，所以中国人杀黑人也不需要负责？
美国所有法律是由法庭来阐释的，所以美国的法律有案例法，precedent law: (
Precedent Definition: A case which establishes legal principles to a certain
set of facts, coming to a certain conclusion, and which is to be followed
from that point on when similar or identical facts are before a court.)
因此，后继的案子必须要follow先前的案例。正因为这样，黑人才抗议，因为根据先例
，纽约黑人小贩那样的情况就是不该被勒死，认为勒死了法庭不处理就是对黑人的歧视

Akai Gurley也是个劣迹斑斑有着多次贩毒和被捕的记录的烂仔。但在这个case里他就
是个受害者，跟他以前的违法犯罪记录无关。不能因为Akai Gurley是个烂仔就减轻梁
警官误杀的法律责任。
就算那女的也是个放高利贷的，在这个case里她也是（至少是非法拘禁的）纯受害者。
她以前有没有放过高利贷不应被考虑。
当然这是从法律角度来分析。由于兲朝不是法治社会，土共一直提倡讲政治高于讲法律
。所以讨论这个也没有意义。 |

The day before Yesterday, I watched a video on CNN, it listed the victims of
police brutality, and the first one named was Akai Gurley, not even Eric
Garner.
For Akai Gurley, I would suggest the victim family hire their own forensics
expert to investigate. Or NYPD cop Peter Liang's family can do that. Because
at first the NYPD said it was an accident, a ricocheted bullet from Liang's

情心似的；对Peter Liang 的支持的标语有歧义，口号说“支持Peter Liang”, 是支

警察打死的黑人，基本上被马桶追认为义子。黑命贵谋杀了警察，马桶总是扇着那对招

单看数据，警察专门杀黑人的结论就已经不成立了。你总不能说，494个被杀的白人都

我不认为警察会针对黑人，无故射杀黑人。绝大多数被射杀的黑人都是拒捕，跟警察玩
硬的。
暴力拒捕被警察打死的，虽然罪不至死，可是命运掌握在你自己手里，你他妈的一定要
跟荷枪实弹的警察较劲，不是脑子坏掉了吗？再大的不公，你活下来还可以接着抗争，
被一枪打死了，不就彻底完蛋了嘛。

罪了，所以是把华裔当作替罪羊。
直觉上是这么回事，但是看了很多讨论，有人认为这个理由是不好堂而皇之的公开用来
抗议的。否则有要求“像白人警察一样有杀死黑人的特权”的嫌疑，道义上站不住脚。
好像也有道理。
如果从另一个方面想呢？
如果Akai Gurley不是黑人，他还是会成为枪击事件的受害者。因为梁之前根本就不知
道谁在下边，这和其它白警杀黑人事件有最大的不同。
但是如果Akai Gurley不是黑人，梁还会不会被如此定罪？
不知道有没有其它白警误杀白人，白警误杀亚裔，亚警误杀白人的案例，是怎么判的。
如果在其它不涉及黑白冲突的案例中，警察一方都没有起诉或定罪，那梁被定罪，就说
明有“特权”的是黑人，在道义上站不住脚的就变成他们了。
在这个基础上再提出梁的亚裔身份，是不是跟能让人接受他是“黑白冲突的替罪羊”的

产力低下，因为奴隶社会的劳动者－－奴隶得不到任何自己劳动的果实，根本没有incent
ive去改进技术，发展生产力，奴隶社会的生产率（Productivity per capita)是停滞的

今天看到一篇文章，作者讲述了他春节前在北京捞一个大款“嫖客”的经历，竟然各方
打点花去人民币十二万七百元！
联想到最近的“雷洋事件”，不禁令人唏嘘，原来警方抓嫖的油水这么足啊！
冰冻三尺非一日之寒，这一积弊是时候想辄消弭了。声称代表人民利益的执政党，何不
顺应时势，修正现有法典中民怨不绝的内容呢？
其实办法倒是有，就看政府是否愿意做。当然，先做可行性分析的功课也是必要的。
我们一方面抱怨人口红利用完了，各地出现用工荒，也抱怨城市配套设施建设的用工不
足，以及公益事业无人做，这些都直接影响经济发展和GDP指标的实现。
另一方面全国各地派出所，动态地行政拘留了1至15天的大量违反治安的各类人员。被
拘人员在失去人身自由的同时，做人的尊严也被侵犯，皮肉之苦更是难免，外加还可能
要破财交一大笔罚款。
其实，惩戒治安犯，既可以不伤及当事人尊严，又可解决当地公益事业用工荒，更重要
的是防止了警方的趋利执法，切除了滋生司法腐败的一角。

梁彼得(28岁)被判过失杀人罪名 (manslaughter，或译误杀)，原本最高面临15年徒刑，但是，法官在19日宣布判刑之前，将他的过失歠罪名降为“刑事疏忽他杀((criminally negligent homicide)”。
司法界人士认为，法官对梁案的量刑裁决，不应是替死者格利“报仇”，而是为人民执行司法正义。死者格利(Akai Gurley，28岁)遗有一个3岁女儿艾凯拉 (Akaila)及同居女友巴林格 (Kimberly Ballinger)。

纽约时报发表文章专门说“梁警官事件华人社区分离的看法”，貌似很客观地报道了一
下华人的主流意见，而且允许评论。
