Just received the small claim appeal court’s judgement in my favor. Here is
the story.
In last December my car was rear-ended by a negligent driver. Claim was made
to Allstate Insurance, the at-fault driver’s insurance company. Two weeks
later, we discovered additional damages. Supplemental claim was made.
Allstate quickly denied the follow-up claim, citing that’s a prior

几个月前从HomeAdvisor上找了一个review还不错的附近town的一个
construction contractor做一些yard work和砍树,可是自称是4天的活
拖拉了几个月还没完成。砍树是他外包给一个朋友了,由于来得时间
短,都没有砍完,他答应以后再来砍。之后就是等town permit花了
近一个月,下雨耽误了几天。等可以正式开始干时contractor一般来
1-2人干1-2个小时,然后就不见影了,估计是他同时在别的地方干。
从第一天干到把草籽撒到地面上,估计有近1个月时间。这几个月里
给他打了估计有100个电话,每次打电话都说明天来,明天到了不来,
再打电话还说明天来。我也从开始的脾气很好,到最后恨不得骂娘了。
最后地整好了,草籽随便一撒,就要所有钱(之前已经分2次付了2/3)。

我经过类似的事情。开始也是打了好多电话,就是没有记录。根据电话里一个court的
人的指示,在ticket上说的日期去了趟court, 拿了一个去了court但court没有记录的
证明。court的人说还是要定期查, 加州的警察可以在两年(也可能是一年内)给court
上交ticket.
过了半年,以为这事都过去了,收到一封警察局的信,原来那个警察ticket有一项信息
没填,所以court不接受,现在把这个信息加上,不影响ticket的有效性。NND。。。没
多久,court那就能查到case了。

There are 12 tennis courts at the Wheaton Regional Park in Maryland. 6 of
them are indoor courts so tennis can be played on rainy/windy days. While
the outdoor courts are free,an indoor court costs $14/hour during the summer.
Those are great courts, and people are very friendly. This morning, I was
invited to and played a pick-up doubles when I walked by the outdoor courts
after dropping my kids off at the indoor courts. It is a summy moring with

上来update一下,钱要回来啦!
我们州申请judgement lien还有点麻烦,要先把judgement transcript从小额法庭转到
superior court,然后第二天会给一个新的case number,之后要等十天才能放lien,
还得填表委托sheriff做。我们的时间是不够赶在卖家和新的买家约定的过户日前放
lien的。因为首先在小额法庭申请certified copy of transcript就要好几天,等转到
superior court后再等10天,人家房子早就过户了。不管怎样,我还是先把case转到了
superior court,拿到了新的case number,然后告知卖家case转到superior court了
,如果不还钱,就会有court action之类的。还好,对方很快就还钱啦!
感慨一下确实这类纠纷官司好打,钱不好要,从file court claim到拿到判决基本是个
很漫长的处理过程。我们真的运气不错!
感谢大家在这个过程中为我们出谋划策,学到了很多,鞠躬!

你说的打cross court buy time的论点是正确的,但是“如果你一开始打
running forehand cross court,对方回球的角度基本都是向着你来的”
这点就不对了。为啥别人不会打running forehand down the line回到
你的反手侧(尤其是遇到偶这种根本不会打cross court的)?其实running
cross court比down the line更需要发力,容易导致重心向场外甩,归位
更不容易。只不过cross court飞行时间长,所以归位时间上更充裕。
所以偶认为像那个FL老头说的那样,这种球要么go for the winner
(down the line fast ball), 要么buy time (cross court slow ball).

那就更好了,原来这个法院的法官还 forming a panel of potential arbitrators,
the Members of the Court from each member state constitute a “national
group,” which is entitled to nominate candidates for the election to the
International Court of Justice (article 4(1) of the Statute of the
International Court of Justice).
也就是说这个 Permanent Court of Arbitration 和那个 International court of
Justice 还tmd 是 associated! 那就更有意思了, 原来这些法院的法官是通用的,
都是会员国政府指派的, 肩负着联合国的行政委托职能,那么其判决就更权威了。 判
了就相当于联合国法院认可了。

Koreans to use their real names on Internet forums was unconstitutional,
forcing the government to change the five-year-old regulation created to
reduce anonymous criticism of politicians and celebrities.
The court said the requirement amounts to prior censorship. It also said the
law violated citizens' privacy, was technically difficult to enforce and

but likely will not — establish a nationwide, constitutional right to gay
marriage. The cases leave the high court plenty of escape hatches from
taking a big step the country may not be ready for yet, said William

车停在小食品店门口停车场, 出门刚好看见黑MM还shopping cart随手猛推, 根本没
推到该还位置,shopping cart还没停下来就倒在咱倒霉的小车上。 问题不大,但撞了
一小坑加一些划痕,在一年新的小车头已经很明显了。还好黑MM准备开车离开前被咱逮
着。
咱当然认为是黑MM的错, 本以为要他们保险修修就好了,问题多多...
肇事黑MM方不愿给保险啥的(不知对方有没有保险), 先叫来老公说自己擦擦,修修啥
的,就不愿让咱自己修,没法令人相信。后来又叫来一黑大叔,态度极端嚣张,说在停
车场都这么扔shooping cart,没啥责任,有问题都是商店的。后来嚣张的开车跑了,
无语!
问了警察, 说可以通过small court处理。现在先记下了肇事者车牌号(没给保险,
registration card),书面写了车被撞经过,小商店老板签了字并留下电话, 准备通
过small court找 黑MM 修车。
问问:
1)这样小CASE找small court 有用吗?
2)File small court 需要提要求吗? 比如要求对方修车啥的。

三个月前的ticket,当时警察说2-3个星期会受到信,不然就电话给county court。后
来打电话给court,他们都没有我的信息,叫我等到这个月底再打。。。我怀疑是警察局
忘了(遗漏)把我的信息给到court,所以他们至今不知道我这个case。我是不是不去
管,就会没事了?还是一定要追问court直到受到notice letter为止?

Car accident and Small Claim Court(纪录+经验+吐槽向) 作者: 姜杉
本文要描述的是我自从去年感恩节被involve into a car accident以来经历的一系列
事情。思来想去,事情之所以拖的这么久,一方面因为肇事者实在是过于奇葩,另一方
面是因为自己对于美国的一些办事的流程以及司法体系不甚了解,以至于某些环节上走
了一些弯路。在此写下自己校内的第一篇正式日志,记录这8个月来的种种经历,并且
从自己的经历总结一下遇到类似情景时的处理方法,还有我的一些闷在心里大实话(吐
槽发泄啊!)。
我感觉我有好几年没有正式写过这种文章再加上每天讲中文实在少,文笔不通还望见谅
。以下均为自己从自己的经验上整理,大家如果有补充一定要告诉我免得我误导别人了。

一个多月前在停车场碰了别人车,留了条走人,后来收到警察ticket,打电话去not
guilty,安排在今天晚上先跟检察官会谈,然后出庭
开了70多迈快两个小时到了法庭,检察官门口排着长队,有意思的是第一个排队的居然
是打电话给警察举报我的目击者,于是我从最后一个排队先进了检察官办公室
里面乱七八糟5-6个人,有另外一个case的当事人和律师,那些律师跟检察官都老熟人
一样
高潮来了,检察官说:你留了条,保险处理,等等等等,我都知道,但是你要报警,不
报警就吃了这个,最严重驾照吊销,罚款多少,甚至坐牢如何如何,然后说这样吧,我
把这个case downgrade成fail to report,没扣点没别的,你交个fine认罪好了
