如美国政府不认为自己对印地安人有完全的Jurisdiction，所以宪法14修正案就不适用
于印地安人。直到1924年才推出专门的法律来处理印地安人的出生国籍问题。
美国政府显然没有外国人包括非移的完全的Jurisdiction，所以宪法14修正案其实压根
就没有给予外国人包括非移的出生公民权。

这个birthright citizenship debate说得就很明白很有道理：

够简洁了吧？跟黄金德的父母是否合法无关！
贴一小段这个判例吧
这里把非法移民和合法移民对于是否适用jurisdiction做了非常详细的解释
而这个是否适用就是当初判黄金德是美国公民的关键！！！高院认为黄金德的父母适用
美国的jurisdiction，所以他们的孩子是公民。同理，因为现在判例说非法移民同样适
用美国的jurisdiction，所以他们的孩子肯定是公民。你们也不想想为什么1982年的判
例后，就没有人去挑战过，就是因为太明确了！！！
你们如果连这都看不明白，就别继续讨论了，实在没什么意思

相关的是 515.329.b, Any person within the United States, 其定义在
515.330, 515.330.a.2 包括了 Any person actually within the United States。所
以当前的定义是包括非法移民的。这两条code都没有明确排出外交使节。因该是另有规
定。这个定义，多大程度上是14修划定的，并不明确。
515.329.a我的理解是公民，绿卡和公民不管人身在不在美国，都算subject to the

1.可能丈夫通过某种方式跟Nevada建立某种联系；Nevada对离婚有Subject Matter
Jurisdiction，对丈夫有Personal Jurisdiction就可以做出离婚判决；
2.Nevada的判决即使没有对妻子的Personal Jurisdiction，也不妨碍他们做出判决；

刑事被告可以选择plead the fifth（第五修正案，不得被迫自证其罪），完全不上证
人席。但如果刑事被告选择上证人席为自己辩护，则放弃了第五修正案下的权利，而必
须回答控方所有问题。
如果证人处于法庭的subpoena power之内，被法庭subpoena而不作证可以导致被判藐视
法庭。特例是如果回答某些特定问题会导致证人自己被牵涉进刑事犯罪，则证人可以选
择在这些问题上plead the fifth拒绝回答。
美国警察逮捕、拘留嫌疑人需要probable cause，另外拘留有期限限制。区别是美国嫌
疑人有宪法第五、第六修正案下保持沉默，和要求律师在场的权利。警察必须通过
miranda warning告知嫌疑人这些权利。违法嫌疑人的宪制权利所获得的口供不能作为
证据。

第一种解释就是一直以来的subject to the law of the United States，第二种解释
就是近来有人提出的reinterpret "subject to the jurisdiction" so that it doesn
't include anybody who's not a citizen or lawful permanent resident，换句话
说就是"subject to the jurisdiction" means either a citizen or lawful
permanent resident who's subject to the law of the United States。

二，CC 从来没有在任何一个学校试验过。他们自己称有大量研究支持这个标准，但却
拿不出一个研究的 citation。我在 CC的官网没找到，如果那位找到了，请分享！
既然没有任何试点，没人知道 CC 是否真的能改进中小学教育。反正 Bill Gates 的孩
