In California, Under California law, 21 calendar days or less after you move
, the tenant must receive the security deposit or itemized statement,
I wait until April 22st 2011, since we moved out on March 31st 2011.we have
not received any statement or security deposit from my landlord, and the
landlord refused to give us the address, so we have a real estate agent help
to dig out her address. and send her email and certified mail asking for

In legal term, you are a "tenant at will," and will have to pay rent for the
month AFTER either party (landlord or you) notifies the other of intention to
move out. You'd better follow the book; otherwise who knows what will happen.
Notify your new landlord (in writing, of course.
I really don't know what you meant, "But I still cannot find him [new
landlord]." You know his name, address or not? ). Ask your old landlord if you
can find him. Check phone books for either old and new landlords, etc

Folks,
Can someone has the experiences to give some advice?
My situation:
I had been renting an apartment in Rockville, Maryland for 4.5 years. Last
Dec I moved out. The landlord (a big landlord here) sent us a letter to
charge for various damages
for over $1000 and sent us photos. We took the photos and the landlord
letter to the city's landlord-telant-issue specialist office. The specialist
told us that he thought the so-called damages are just normal tears and
wears and the charges are ridicu

You just got your 5 kids back from CPS. You should try and focus on them. It
must have been a traumatic experience for the kids. Instead of looking for
loopholes around the court decision yourself without a lawyer in order to
not pay the landlord, you should focus on providing a stable environment for
your kids, make them feel safe, help them recover from the ordeal and make
sure they are not going to be taken away from you again.

I have been living in a room for about one year without lease. I got this room
from the previous tenant, who had an expired lease with the landlord. I gave
the tenant a security deposit (to replace his own) and took the room. The
then-landlord said he was okay as long as I paid him the rent.
However, something strange happened about one month back: the landlord sold
the house and the new landlord never showed up. I could not find out where to

Thanks a lot for the reply. It is really helpful.
I really invested a good amount of effort to find the new landlord. I called
my old landlord, but he seemed to have changed his phone number. I contacted
the agent who collected the rent for the old landlord, but they only gave me
the phone number of another agent, who never answered the phone. We have 8
roommates in the entire house, but none of us has been able to know either the
name or the address of the new landlord. Could you please tell me

We moved in a 60 years old house on June 1st, 2008 on a at 3-month lease
base at NJ. (The landlord promised us to stay at least three months and
after that a month-to-month base). When we moved in, the landlord promised
to give us a lease two weeks later (The landlord lives in NY and she needs
two weeks to have the lease ready). She asked us for $1300 per month plus
one and half month deposit.

come on, if it's a check, ask your landlord for bank records that indicate
the check was cashed by your roommate.
Also, you need to go after your landlord,since by contract (lease), he/she
is supposed to return you the deposit. Your landlord can then go after your
roommate if he/she wishes.

去年7月搬出来的,黑心landlord要charge我们很多不合理费用$2500多,detail就不细
说了。我们给地主写certified mail dispute这些charge,他们不收直接退回来。后来
人家直接把帐户卖给collection了。我们给collection写了cease letter。后来我怀孕
,没精力管这件事了。
刚刚又收到collection的信,说要找律师sue我们,我上网查了信用记录,信用记录也
给影响了。
在我写了cease letter的情况下,collection agent还能这样骚扰我吗?这件事情很讨
厌的是,我一直因为忙,不想麻烦,所以没到小额法庭起诉landlord,导致现在。我的
信用记录能通过和信用记录公司交涉改掉吗?还是现在我必须上小额法庭告前landlord
了呢?

The mark bitten looks like bed bugs, the landlord hired a company come
to inspect and gave me a paper saying that no bugs are found, but I am
bitten again. Then I contact the company according to its note for further
inspection, the landlord fired the company and force me to move.
I just switched room with my roommates, found the window was broken,

几天前发现银行帐户被人cash了一张数额不小的支票。让银行给我fax了支票的photocopy
后发现是我Landlord的一雇员干的(我是事后找Landlord核实得知的)。估计是进屋修东西

My friend is renting. She just gave her landlord the Intent to Vacant notice
. Then days later her landlord gave her Notice to Quit.
My friend is wondering whether she should contact the electricity company to
come and verify the miswiring issue in the basement, before she moves out.
Per the electricity company,the landlord should pay for all the lighting in
the basement. But some of that goes to my friend's meter.

和楼上的,同一层楼的,楼下的都吵过,
认为别人都make noise,
现在有三家决定联合签字complain,会有效果吗?
今天晚上七点左右,
三楼的房客说四楼的房客太吵,上去砸门,两家在楼道内吵,
后来四楼的报警,说三楼企图break in,来了17个警察,问了一圈,
没有真正的break in,没有人受伤,就走了
现在四楼的两家联合我们四五家按着三楼那家的,
一起跟landlord complain,
会有用吗?应该如何操作?有什么建议。?
还有一个邻居是法律系的本科生,
建议四楼的两家(今天三楼一家和四楼的两家吵)去警察局备案,
说三楼有侵入企图和暴力倾向。

最近搬到一个apartment,发现屋里有些气味,像是某种化学药剂。头两天,以为是消
毒剂洗涤剂什么的通两天风就好了,也没在意。但通风了一周了,气味没怎么减,现在
觉得不可能是消毒剂。若是建筑材料里来的,那就有毒。找了个化学系的朋友来看了一
下,他也觉得是某种化学的东西。跟landlord谈,他不同意撤消lease,也没有别的房
子可以换,否认气味有毒,说不是不能解决,意思是拿不出足够的证据不能取消lease
。我不想拿自己的身体健康来冒险,最好能撤销lease,搬走。但现在的困难是,很难
拿出足够的证据说气味有毒。不知道美国有没有什么相应的机构管理和调解landlord和
tenant的纠纷,或者能提供一些检测。谢谢!

一个朋友在apartment住了一年,回国前把房子打扫的干干净净,满指望能把deposit的
$200尽多的要回来。回国前留下我家的地址,希望landlord检查好以后,可以把支票寄
到我的地址。一个半月后,收到landlord的信,说是朋友把沙发等放在了垃圾桶里(注

自己要买新车,很希望从landloard那个要个gararge parking.但是landlord只有两个
趴车位,两辆车。如果我要一个,landlord有一两要趴在大街上。
小区还可以,中国人多,车子的基本上是DFBB,更好一点的Lexus, family SUVs。有不
少车扒在driveway上。

Hi I am a tenant. My landlord never opened the gas since January. Every day
the temp is below 55 K. I heard there is a law about the tempature Landlord
should keep in the winter. How much is it? Is their action violate the law?
By the way, they didn't ask me to sign any lease. But every time when I gave
them rent, I wrote a check.

第一次听说生了孩子还要交钱的,那是针对的visitor
一般visitor一年累计一定时间之内是不用告诉landlord的,但是超过了contract上面
的规定,就要通知landlord,多交房租和utility.
即使是cleaning的费用,你也应该要求看receipt,否则必须全部退

看到好几起landlord在美国之外的,
房租还很便宜,也不给租客看房子的里面,理由是landlord人在国外,
还要租客填写租方的申请表格,合格的人会把合约以及钥匙寄给租客。
这些听起来是不是很奇怪,令人难以相信。

It all depends on the state laws of your state. You should not count on others
who don't even know where you are. If you are a student, why not try, as a
first step, a lawyer in your school, though they are not specialized in this.
Besides, nobody but you and the landlord have the lease; we don't know the
contents. Finally, I wonder if the landlord can collect without a judgment
from a court.

You are commended to go through all the troubles. I guess you can leave a note
for the new landlord and move out. But that is only my guess--besides,
different states have different state laws. However, if you (and your
roommates) also want to be free of hassle in the future, go to your county's
Registry of Deeds to find new landlord's name, address and his attorney (or
agent). In Massachusetts, record of Registry of Deeds has been online for a
few years (possibly 2, I am not sure), free. So che

Be reasonable. Try to resolve this minor dispute with your landlord
yourself by calling her to explain that you tried your best to move out ASAP
. There was a reason that she was angry and found out why.
Also, you will not be able to get any magic advice on this board to solve
this problem. If you want to pursue legal recourse, retain a NJ licensed
lawyer and pay probably anywhere from $200 (for a letter to your landlord)
to several thousands (or more) for a prolonged legal battle.

Two guys signed lease together, each paid half a deposit. After lease
termination, they moved out. Landlord returned the security deposit check
with only one tenant name on it to one of them. Generally,landlord should
write a check with both of tenants names on it, so this check can't be
deposited or cashed without either signature from them. This guy who got the
check kept the whole deposit, refused to give half portion of deposit to
the other. If file a lawsuit, who should be defendant?

因为我们这套房子里有太多的蟑螂,家里有宝宝(8个月),而且我们也找房东(是个
蛮大的公司)很多次来解决这个问题,都解决不了。有一次还在宝宝的床上发现了蟑螂
,真的受不了了。所以想argue一下终止合同(合同7月到期),大家觉得有可能么?在

mitigation takes effect if the contract is silent. However, if the contract
clearly states you cannot sublet without landlord's consent, then you
cannot use mitigation.
I suggest you evaluate your case objectively. Claiming you were free to walk
away because your landlord failed to make sure the tenants were obeying the
laws doesn't sound like a slam dunk case to me.
Of course, if you're willing to forgo the deposit and just disappear, it
might just save both parties a lot of headache...

怀疑这个landlord想敲诈一笔,说我们把他的built in freezer弄得两小块硬币大小的
scratch。但是我们觉得这个是以前就有的。他move out inspection的时候,我才发现
,可见是多么不引人注意的scratch。而且freezer那边都很少用的。很难想象我们这一
年里把它scratch了。
那因为是built in,他先扣了钱,说invoice过后寄来。
我们在CA。请问,legally,他们多久之内要provide invoice?
另外,能要他去年tenant的move out吗? 怎么能保证他不forge document呢?
这landlord的极品就不多说了。请懂加州出租法律的帮忙看看吧。多谢!
