store, not online). This is the first generation model, but it was just

H-1B的相关问题
在有些H-1B外籍員工正处第七年的延期 (基于已提出申请的第一个劳工证申请)，但第一
个劳工证申请被否決了，该H-1B外籍员工工若是其第七年的H-1B身分过期之前业已提出第
二个劳工证的申请，并且该第二个劳工证的申请已经提出超过了一年，则NSC认可第八年
延期的申请是可能的。
O签证的相关问题
就O签证的审理，NSC表示有些职业不符合O的要求，即便是该职业可归类于符合申请的领
域，例如像是武術，擁有黑帶五段段術本身並不符合O签证的要求，但是，如果在国际竞
赛中得到獎牌就可能符合O的要求。
关于推荐信的部分，NSC表示推荐信若是來自曾和该申请人一起學学习或工作者，则比较
不具分量，若是來自其它同行的专家 (outside the circle of colleagues)，NSC认为这
样的推推荐信会比较客观，所以会給与较重的分量。
另外，NSC也表示，O的核准是基於该申请人已经或得的成就，它们不会核准那些论述是基

应。今天早上有一位Nebraska移民官打电话给我们查询一位申请人的资料。可能是快要
Thanksgiving大家都慢了下来，这位移民官竟然和我们聊了起来。从我们谈论的内容主
要还是在EB-1及 NIW的问题里。这位移民官基本上是位资深的移民官，他说平常他只要
看看申请所准备的资料就可以判断出是否某个案子可以批准。虽然我觉得这可能主观了
点，但是他自己认为所有的申请人都具有专业的背景，移民官是不可能对这些有充分的
了解，而且移民官也不可能去读完一篇二三十页的Cover letter。所以当一个案件送到
他们的手中时，他们必须很迅速得先将申请人的简历与推荐信拿出来，而且在20分钟内
结束审理。由此你可以想象如果你准备厚厚的一大堆东西几乎没有人会去看的。这位移
民官特别跟我们提到为他个人而言，他比较注重推荐信。他不大喜欢看到千篇一律的标
准推荐信，反而希望是看到比较generic的信，不像是有人特别套用有格式的推荐信，

发帖数: 947 | 32 上周五我们知道从四月一日起，所有的I-129的申请(H，L，O等签证) 都将送到Vermont
Service Center，所有的I-140都将送到Nebraska Service Center。可以想象的是到时候
一定会很混乱。尤其是H-1B也是从四月一日开始申请。虽然Vermont可能会见将原本属于
California, Texas, 或是Nebraska 的案件送到该中心处理，这里面所造成的延误是可以
预料的。当然CIS说 Receipt Notice 将由Vermont统一寄出，甚至于如果申请寄错到CA，
CA仍然会再把申请寄到Vermont，然后Vermont收到之后，再寄回CA。如此来回究竟好处在
哪里实在让人费解。
对于I-140送到Nebraska的问题可能影响更大。如果Nebraska只是负责收件及分派I-140到
各不同的Service Center还好。如果Nebraska将留下一些I-140自己审理，恐怕将不是太
好的事，因为大家都知道Nebraska对于所有的I-140都十分严格。目前为止我们还没有进
一步的消息。我们也没法想像Nebraska将有能力处理 |

发帖数: 947 | 33 前一阵子我们曾经提过在Nebraska 申请的I-140，有时他们发现申请人同时有EB-1a，
NIW或以LC申请的I-140都在Nebraska，而且要求申请人决定是否要撤 回EB-1a或NIW。
CIS认为申请人已经有了一 个以 LC申请的I-140，所以按NIW的要求自然无法证明申请
LC会对美国有利。对此好些客人不知如何处理，最主要的原 因是不想再为目前的公司
工作，因 此很 想EB-1 a或NIW能继续下去。但又怕不撤回这些申请，Nebraska将会马
上否 决这些申请。几经考虑我们决定按法 律上的条件，对于申请人的资格与贡 献详
细的说 明。而且跟Nebraska说 明法律并没有禁止一个人可以有多个I-140的申 请。因
此Nebraska不能要 求申请人撤回任 何一 个I-140的申请。到今天为 止我们三个相似
的案件都得到Nebraska的批准。因此，并非所有CIS所说的都要听。只要你认为有理，
就该争到底。
另 外往 往在申 请I-140时，Nebraska要求提供公司的财务资料，或 是申 请人的工作
经 验证 明。只 要是合 理的，我 们会建 议客 人拿出来。如果不 |

发帖数: 1077 | 37 首先需要明确的是真正重要的是各个Poll的小分，而不是相对名次。
%分数，0.04差距才是才是真正一个名次的差距。像上一周两个人工poll上
Oregon高居第一，Auburn和BSU是split第二第三名的票，差Oregon实际是
一名半。而计算机poll上Auburn高居第一，Oregon差一名多，TCU差两名多。
BSU差了5个名次！
人工poll的规则其实很简单，赢球的名次顺序基本不变，输球的踢下去。
同是赢球BCS球队能跳过NAQ球队，但是一负的BCS跳不败的NAQ很难。即使跳过去
分数也会很接近。计算机上看赛程难度，对一负BCS球队机会大些。
现在局面其实已经很清楚了，
1. Oregon和Auburn如果全胜，Oregon两个人工poll第一
Auburn计算机poll第一，这个都是不可动摇的位置，双双进入冠军赛。Oregon可能
性较大（全胜概率60%），Auburn剩下的还是场场硬仗(全胜概率40%)。
概率：24%
2. 如果Auburn和Oregon有一个输了，TCU进冠军赛。昨天TCU大胜Utah这一场意义
