上面出现了两个法官，都一致同意案件中的解释。哪里有法官disagree 的意见？

我是ＯＰＴ 2014十月底到期
他的visa和ds2019都是写not subject to 212e. 我们也问了学校的OISSS, 也是说不
subject
于是我们一直对此也没有怀疑
10月我们已经提交了niw 140, 现在结果还没有出来
当时在律师的建议下 我们去要了advisory opinion, 觉得这样比较保险以后485就不会
被 ＲＥＦ
今天刚在网上查到advisory opinion的结果 竟然写的是subject
很出乎我们的意料 于是也打乱了我们所有的计划
我们本来是想2月交485， 这样有了combo卡也就不用改变身份 直接等绿卡
可是现在advisory opinion居然说是subject
即使我们递了485，应该也是会被拒吧。。。
不知道现在该怎么办才好呢？
即使现在马上办waiver 也不知道什么时候能办好 也不见到8月底能办好
现在的状况，我们递了140了，不知道还能延期ＬＤ的Ｊ1吗？
我的几个问题是：
1。 交了140后，ld的Ｊ1还可以延期吗？还是485递了也还是可以延期Ｊ1？

发帖数: 1 | 9 J-1要不要waiver只有DOS的advisory opinion说了算。楼主要赶紧file advisory
opinion，一般要三个月以上才有结果，这个结果是写在一封信上，这封信是最有法律
效力的文件。如果advisory opinion说要waiver就必须要waiver。
另外，中方只能给同一个人一次No objection letter，第二次就不会再给了。如果还
想搞waiver，只能绕开中方单独和美方搞，除了No objection letter外还有另外四种
方式，具体请google Waiver of the Exchange Visitor Two-Year Home-Country
Physical Presence Requirement。但是剩下这四种方式都非常难，建议赶紧找律师解
决。
advisory opinion和找律师搞waiver可以同时进行，互不冲突。Good luck! |

1）我是J-1（过期日期11/12/2016），是博后老千，我老婆J-2。
2）我的J1 waiver已经拿到手，并且NIW-140已经通过。
3）刚接了另一个大学的offer，双方约定给我转H1b在07/05/2016生效。
4）我老婆怀孕了，due date是07/24/2016。
5）本以为一切顺其自然就能转H1B，材料都已经发给学校律师。但是在整理材料的过程
中忽然记起老婆在2010到2011年间曾经是J1，因为她的J1 visa和DS2019表上都写着“
not subjected to 212e two year rules”，所以一直以为她不用搞豁免。直到前两天
看到版上好多人说就算visa和DS2019表上说not subject to 212e，只要是中国护照，
就要搞豁免，直接吓尿。
很多人说找DOS搞advisory opinion是最有效力的，所以今天打算把这个advisory
opinion先搞上。但是听说结果要1到2个月才能下来。如果新学校file了从J1J2转换成

我看网上很多人说只要是中国人都要豁免。然后去DOS waiver 网站上做了个survey，
结论是“She may be subjected to two year rule because her home country (
China) is on the skill list”。
所以还是先把advisory opinion先搞了再说。就怕两个月后advisory opinion结果是
subject to 212e，到时再搞豁免岂不是晚了？ |

我觉得这一步你可以自己填，装作医生，把病史（我给你翻译的）填上，可以快一点。
如果医生和你熟悉，会马上帮你做的，让他弄/或至少让他知道你帮他填了比较好。因
为你拿到美国医生的诊断和方案后，可能要和你的医生讨论。
3）病人或医生上传（或邮寄）诊断资料(病理或影像，测试或测试结果，病例)

google doc和地图，和老刑愿意赞助的伪币，都不要浪费了，没啥太大的理由，这个有
氧活动不继续下去啊。你的性格很好很直率，做版主后，多控制自己情绪，最多不过自
己受气，也不能给别人气受。坚持原则上，你会做的很好的。
yager，有热情脾气好在家也是模仿老公，受得住老婆的气。你要不试试做3个月版主啊
，做了版主群众的眼睛会让你很容易一天不拉运动下去的，版主的位置也能让你看到更
多有趣的事情，其实是挺好的经历。

someone's opinion (apparently from a very narrow-minded person). In this
country, everyone has the right to express their opinions. There is nothing
to protest against.
The best thing to do is write ONE letter to the same editor to counter his
opinion with sensible arguments and supporting evidence. Stop being overly
sensitive! The more we protest, the more we will be perceived as "enemy". |
