我家有一个rental property A, 我们以此抵押申请了20万的home equity loan, 然后
用这笔钱作为首付,另外贷款30万,又买了rental property B。
要报税的话,那个30万mortgage的interest可以作为rental property B的expense, 这
个没有问题。
而开始那个20万贷款的interest应该也可以作为rental property B的expense的一部分
,(因为有这笔钱我才可以买到property B),可以deductible, 对吧?

给了买家2016的部分property tax作为credit。
现在填2016报税表时遇到一个问题:2016交了多少property tax?
请问一下,应该用前年的property tax 加上给买家的credit部分作为我一共在2016交

请教一个Property Tax的问题。
去年底把18年4月due的那部分property tax提前交了(等于是去年共交了三次半年的
property tax),以为可以省17年的税。可是在TurboTax里加入了这份额外的property
tax之后,退税数额完全没有变化。是因为每年可以抵税的property tax有上限吗?还
是因为那个什么AMT?怎么知道有没有hit AMT?

看了一处新房子2009年的,在Long Island City, Queens

目前property tax是$200/per month, 说是12年以后以每年20%增长,直到差不多$1 /
per sqft??
也就是差不多每月$1200的property tax? 感觉对于一个两室的condo很贵啊,而且还
有$1000左右的物业管理费,还不如租房子呢。
网上查了,Queens property tax average is 0.55% of condo's market value. 那不
是因该每年$5500, 每月就是$458 ?
糊涂了,还有,NYC的property tax又是多少?因该比Queens高吧?

前端时间找了contractor比较大范围地remodel了自家的房子,后来收到king county寄
来的信说,根据申请的Permit来看,这个remodel可能会增加property value所以可能
要涨property tax。信里说要我们在工程完全结束前去申请 home improvement
exemption (HI),可能可以头三年的property tax不涨。有几个问题不清楚:
1.从哪里可以知道我们的property value要涨多少?如果不去申请这个HI,county会来
我们家实地看要涨多少吗?还是他们坐在办公室里根据permit申请时填写的工程成本数
据就给我们涨?涨多少?
2.property value和tax的上涨比例是多少?哪里可以查到计算公式?
3.我们工程绝大部分完成了,就剩车库的一点点,不影响居住。我们怎么和county证明
这个工程还没结束,所以可以申请HI?
4.申请HI还有什么需要注意的?

不过好消息是今年(2011)开始有些业主不用开车跑去Angleton了,可以efile
protest,省了大半天时间和十刀汽油费。
我们收到的信上说是limited group of eligible residential homestead properties
的业主可以申请。
protest表上印了user ID和PIN,去efile.brazoriacad.org上注册激活帐号,然后就可
以填写protest表了。
随时可以登录自己的帐号去查处理的状态。
真的是方便多啦!

如何自己Protest Property Tax
经常有朋友,网友,客户请我帮忙请我帮他们从我的数据库里查询最近房屋成交的记录
,看能不能找到有用的信息帮他们protest their property tax。其实如果要申诉自己
的房产税,自己也可以做而且效果更好,以下信息教大家怎么自己申诉降低自己的房产
税。
有两种途径获取你所要的信息:1. 请相关人员帮忙查询近期和你房子情况相似的房屋
成交价(面积,卧室数量,卫生间数量等参考数据),如果低于你的home value,你可
以用这些信息上网申请protest property tax。但是,通常在今天这个市场上,房屋的
售价在逐渐上升的情况下,要找到对你有用的信息可能并不多。2. 我们可以使用公共
数据库hcad.org(Houston only),查询同一个社区的邻里的home value, 如果他们的房
屋情况和你的类似,但房屋估价低于你,那就可以使用这些信息去申诉。下面是具体的
抄作步骤。

他们给我寄来一个信,说我欠了prepaid property tax, 还有estimated property
tax 一共大概700。
另外他们还要我付将近450的excessive wear and use。我之前车后面的bumper是稍微
刮了一点点,都是很短的痕迹。之前来做end of lease inspection的人后来网上给的
报告也没说需要修。我打电话去问了,接线的也肯定说如果那个人没说,那就不用去修。

父母在另外一个州有一房子。经朋友介绍,请了一个人当property manager.我们有跟
她签了3个月的listing contract,management contract 据她说是跟租期挂钩,但我没
有看到这一条在managment contract里。managment contract 里有提到,如果我跟她
提前中断合约,我要给她一个月的租金,还有40前的notice,但合约里没有提到,如果
是她提前中断合约会怎样。但是,合约里只有她的签名,没有我父母的签名。我们只签
了listing contract, 还有跟租客的合约(里面有提到property manager 所在的公司
代理我们的房子)。现在问题是这个property manager态度非常不好,还经常擅自做一
些维修,然后给我寄账单要我付钱。也不跟我商量一下,那些维修是不是有必要的。更
过分的是竟然擅自把我们的门锁换了,也不给我一套钥匙。我感觉就是,她就借此刮钱
。我很想把她炒掉,但又怕她到时候要求我给她一个月的租金,因为我很不甘心。房子

when u first bot ur house, u paid portion of property tax in ur closing fee.
that tax is calculated based the previous price of the property. later in the
year, ur property tax got re-calculated based on ur buying price. the
difference is the supplemental tax. e.g., the old price of the house is 300k,
but u bot for 500k, and u paid ur portion of property tax X% (prorated) x
1.14% (or 1.04%) of 300k when closing.

比如seller的property tax是5000
等我买了以后,因为成交价低,所以只有1000
buyer agent和我说,在closing fee里面我需要把09年5000剩余的property tax交掉。
以后就是按照1000的收。
那09年的tax具体是从几月份到几月份啊?
我是在county的官方网站上找的
它有一个NEW HOMEBUYER’S TAX ESTIMATOR,只需要输入purchase price,再加上一些

Does anyone have experience with the assessed price of property, I purchased
an REO house at the end of May and the L.A county office assesed the value
of the property 15% higher than the purchase price and want me to pay
property tax based on it. I heard people saying you pay property tax only
based on purchase price.

lender是怕你个人担保贷款,而房子又不完全属于你。
除非你已经决定会离婚,签这个对你们不利。
你这个情况虽然你个人是borrower,但property也不能算seperate property(只有你
拿你婚前财产付清这个房子,才是你的seperate property)。

separate property form,还要公证。这个办了是不是就是说即使已婚,买到的房子也
是borrower 一方拥有,而不是夫妻共同拥有?

以前我们这里的property tax rate是>3%,而周围几个城镇都才2%左右.当然这里的老
百姓有意见了。后来镇上把全部的房子重新估价,往上提高至少20%,这样property
tax rate就降到3%以下了。每年我们交的property tax并没有变。所以要看每年交多少
钱,而不是property tax rate。

发给每户一封信说是否愿意参加,如果律师appeal有效,会收取40%的减少的property
tax.有几个相关问题,想问问谁有类似经验。
(1)信里没提这个费用是否就是一年的,否则以后每年都受40%?不过也可能就是每年
都受40%减掉的部分。
(2)如果不签字参加,难道如果律师appeal成功,county只减少参加户的property
tax?这个不太合理吧,都是一个小区的townhouse,为什么会差太多?就是觉得如果小区
里的其他没参加的住户,也减少了property tax,那就没必要参加这个appeal了。
(3)还是说,如果不参加appeal,就表示接受了county assessor的估价,尽管有可能
我的邻居参加了appeal,最后减了很多property tax?

今年前10个月的Property Tax应该作为Ccedit,在closing的时候折算给你的。但是今
年交的Property Tax是去年的,应该由前Owner交,跟你没有关系。
你今年不需要交Property Tax。
十月closing,明年才开始由你交今年的Property Tax (前十个月已经折算给你了)。

我也在加州。去年close的时候专门对比了这两个的区别。community property with
right of survivorship 跟 community property类似,主要区别就是夫妻之间房产权
转移的时候不用再花钱办手续,方便很多。需要声明这个选项,不然escrow做文件的时
候很可能想当然写成community property。

Depends how the property tax is calculated. In some states, tax on new
built property (condo, SFH, etc) is dertermined by the sales price * a tax
ratio.
The old property is taxed based on old, old price, which is used as tax
asessment base. The town may not reassess the amount for years, so the tax
is very low comparing to the recent built property.

Are you in California? California has a local property tax limitation called
Proposition 13. See http://en.wikipedia.org/wiki/California_Proposition_13_(1978)
The local property tax rate is 1%. The assessment grows only 1 percent a
year regardless of the market value. It will be reset to the fair market
value only when the property is sold. After that, the assessment grows 1
percent a year again until the ownership of the property changes.

加州Santa Clara
现在的owner每年付$1,800多的property tax,过户后重新计算,每年要付$8,000多。
如果10月底过户,新的property tax什么时候重算?是11月1日,还是明年1月1日?
如果seller提前付了property tax到年底,buyer给seller报销最后两个月的property
tax,是按旧的tax($300多),还是按重新计算过的($1,300多)?

第一次买房,不是很懂
我们的property tax是分两个installment交的,第一次去年11月交了,第二次今年马
上要交,那么,报2012税的时候,是不是只能deduct第一个installment的?还是两个
installment的全都可以deduct?
另外,报税的时候需要上交什么特别的文档来证明这些property tax吗?我们的bill和
付款都是网上进行的,在CA的alameda county,不知道网上下载下来的那个property
tax - internet copy可不可以当作这个使?我们没有办escrow account,直接去county
交的,所以银行的1098里面property tax为0

现在在看一个房子,property tax是基于一个很高的价钱,因此很贵。listing agent
同时也做我们的Agent,她说那边的房子正在重新估值,会自动依照listing price降
property tax,然后我们找个consultant去grieve一把,就能再次降到按照closing
price征property tax。如果按closing price算,property tax可以降25%.
想问一下,有没有住在westchester这边的人了解这个的,觉得这个dual agent以上所
说的靠谱吗?

借lz贴问问。是投资房才要schedule E吧。
我的是自住房,2013年底close的。除了交2013年剩下的几天的property tax和2014年
全年的保险。
它也多收了3个月的property tax和insurance fee在escrow account.
那报税俺就只报2013年的property tax还是要加上多收的那三个月的property tax和
insurance?
俺用turbo tax填的时候,它没提醒这些哦。。

买房的时候特意做了plot plan,自己的property都在自己地上,
搬进来后发现本应该是直线的边界,被邻居家的后院侵占进来大概2个feet左右(总面
积大概40 sqft的样子,两家后院之间有共享的fence,final workthrough时候问了list
agent,说这个fence应该是我们建的)。如果不是邻居家侵占,也就是我家前院的草地
有一小块是他家的(我家草地边上是他家的铺好的driveway。但根据plot plan的比例,
他家侵占我家地的概率要大些,但plot plan没有法律效率,大家觉得有必要做
property survey吗?除了占地,还要把前院围起来,现在都不知道该围到哪里,也不
知道边界上的树和shrub是他家的还是我家,现在当我家的天天给他浇水了。

这个话题与贷款本身没有太大关系,但却是几乎每个买房的人尤其是第一次买房的人都
会问的问题,就是,我已婚,房子的title应该怎么写比较好?
在加州,夫妻共同买房有两个比较常见的title:
1. Joint Tenants;
2. Community Property with Right of Survivorship.
这两个title有很多对比之处就不一一列举了,只叙述两个与买房者利益最相关的部分。
首先,在产权转移上,两者没有什么区别,在一方死亡后,另一方都是自动继承死亡一
方的权益,例如丈夫去世,妻子自动独自拥有房子100%的产权。
那么,为什么在加州选Community Property with Right of Survivorship比较好?因
为从税务的角度考虑此种title可以极大的省所得税(Capital Gain tax)。例如,夫
妻两人2008年花费$600K买了一栋房子,到了2015年,丈夫因为意外去世,妻子自动继
承丈夫产权,并需要卖掉房子,此时房子价值已经涨到$2M。如果房子的title是按照

这样不一定合算。你如果等到1月份再付可以把这笔钱算到明年的退税里。把两年
的property tax放在一年付,而另一年用standard deduction,在很多情况下能退更多
的税。

mortgage company给的1098表,Box1是记录我去年交的mortgage利息;Box5这一项是Real
Estate Taxes paid.因为有refinance,我受到两张.第一张是从refi前的mortgage
company寄出的.居然是个负数 (-4500).但这实际上是从我Escrow account交出的上半
年的property tax.
下半年我refinance,取消了escrow,新的mortgage company给我的1098上,box5就是0.
实际上我去年一共交了4500 (from escrow)+ 4500 = 9000的property tax.
由于第一张box5是负的,我输入Taxcut以后居然从我的总的property tax里面减掉了
4500.也就是我最后只有一半的property tax被deduct了.
怎么会这样?要不要把那个负的写成零?

每年交的property tax应该是deductable. 在加州CA 540 Schedule A 的 line 39:
39 Enter total of federal Schedule A (form 1040),line 5 (State Disability
Insurance, and state and local income tax, or General Sales tax), and line 8
(foreign income tax only).
好象并没有提到property tax. 那property tax deduction应该放在那里呢?

这是第一次涉及property tax,所以一头雾水,请教大家。
1. 我们12年底收到了property tax的账单,按照账单要求邮寄了支票,并不是贷款公
司管。所以贷款公司邮寄过来的1098并没有涉及property tax,只有interest。想请问
大家,这种情况,我们还是会收到1099or 1098一类的关于property tax的表嘛,还是
需要自己报税的时候按照自己缴纳的数目去填写呀?
2. 还有房屋保险,HOA这些可以抵税嘛?
3. 我们是11年11月底买的房子,12年4月之前邮寄了application for residence
homestead exemption。这个会对反税有什么帮助嘛?需要我们自己去操作什么吗?

Google the town name to get the town's website. Then search assessor's
office. Usually will find a link
to ask you to input the property address for assessment value. If I did not
remember it wrong, you should
Find the property tax value there too.
Also usually zillow.com should have the property's assessment value and
property tax value.

The Illinois House has overwhelmingly passed a property tax cap.
Legislators voted to block suburban governments from hiking property taxes
when overall home values decline.
Democrat Jack Franks of Marengo introduced the bill, saying it was needed to
help protect middle class homeowners from soaring property taxes.
The bill now goes to the State Senate, where it faces stiff opposition from
unions and local governments who said the property tax cap will lead to
dangerous cuts.

In disclosing new tax data, Mr. Orr said the gross levy countywide will be
up just 1.02 percent, to $12.1 billion, with a 1.3 percent hike in Chicago

美国政府(本文特指郡政府)真是很搞笑。。。
我住在DEKALB COUNTY,2011年他们把房子在COUNTY的APPRAISED VALUE搞低。拿我的房
子和我住的那条街的邻居来说,举个例子,原来38万的房子,现在评估值32万(下调>=
5%),也就是5000多的税变成了4000多。
一点也不夸张,他们调整了【所有】PROPERTY的价格,而且全部是往下调。也没有
APPRAISER去各家评估,完全是根据市场数据CURVE出来的。表面看来,房主都很开心啊

Don't bother. You and most chinese home owners probably do not qualify.
Eligibility requirements
As a homeowner, you may be eligible for one or both of the following refunds
if you owned and lived in your home on January 2, 2011.
Regular property tax refund. Your total household income for 2011 must be
less than $100,780 (for 2010, less than $99,240). The maximum refund is $2,
