中午吃完憋屈饭，整理了所有相关文件。抱着“只要功夫深、铁杵磨成针”的决心，再
次驱车20多分钟返回DOT。
大姐“热情”的接待了我，并再次“认真地”喷了我足足近12分钟（我录音了，我无耻
）。她告诉我，不要浪费他们的时间，他们是government agency，每一次request都是
要钱的，现在政府经费这么紧张，总不能一天给我try 10次吧...
我满脸赔笑，说你看，10多天前，这system就不认我。今天我拿了所有的文件了，大姐
你要是没时间看的话，你看我这都给你highlight出来了。而且，这SEVP的文件上面也
说了，用我的EAD A NUMBER + CAP-GAP I20的到期日期，就可以renew驾照...我对灯发
誓，我的态度绝对是孝子对烈妈的态度，大气都不敢出。
哪成想，这一下捅了马蜂窝。大姐立马儿说道，“我这几十年的经验了，用你丫教我怎
么做？”你这EAD CARD明天就过期了，你丫让我用一个过期文件上的NUMBER往系统里面
输？这怎么可能是对的呢？政府经费有限（第二次跟我提这事儿了，眼里带着哀怨啊）

Exchange Visitor Program，简称为SEVP), 于最近公布了截止到2013年6月30日的在美
外籍留学生最新统计数字。
截止到2013年6月30日，SEVP已经批准了 9,522个学校项目。持F-1和M-1签证的在校学
生有 894,826人，这些学生的家属有89,315人，有1,890,942名持 F-1和M-1签证的学生
已经完成了学业。
SEVP 批准的学校中的36%位于加利福尼亚州，纽约州，佛罗里达州，德克萨斯州和宾夕
法尼亚州。
持 F-1和M-1签证学生最多的五个学校为:

information已经发到本地DMV。

but it may come back if SEVP approve it again. Rules change all the time :(

Our advise is that to be on the safe side you not volunteer as it appears
that NSC is taking a different stance than guidance provided by SEVP. It
does appear that NSC in its adjudicating process is asking for pay stubs as
proof of employment, contradicting SEVP guidance. NSC is the adjudicator for
OPT and OPT extension; while OISS only recommends that a student be granted
OPT/Extension. I can understand your frustration, though it is not the

lz现在在用17 month OPT extension 的 EAD 卡工作。现在想申请 额外的那 7 个月的
延期。联系了学校ISO， 结果今天将近5点钟，收到ISO 回复，说我的17 month OPT
extension 在SEVIS record 上 是 pending。
这是说17个月的OPT extension根本没有批准吗？ 但是EAD 卡我都拿到了啊。
ISO的人说要等SEVP correction。 问题是什么是SEVP。从没听说过。而且这个
correction要多久啊， 8月8号之前不寄到USCIS就不能申请那个额外7个月了啊。

中国人讲究一诺千金，Credit不是history或number。它就是我们所谓的“诚信”
T-mobile让你先用他们的服务后付钱，你岂不是恩将仇报？
信用局不可能收讨债公司的记录，因为他们的系统必须有SSN才能接受， 但是SEVP--专
门管留学生的单位可能开始收集这类的资料。 SEVP从2003年开始筹划，他们有全美国
留学生的记录，看看你的签证，有一个N开头的号码， 在学校名字上面， 你在美国所
有活动都可能被记载在这个号码底下。 等你领绿卡或入籍时有可能都连接到一起。
一个月的费用很有限，别为了小钱害了自己。以前我们去t-mobile都是立即开几，现在
我们要等一个小时的credit check。原因就是t-mobile 对每个申请人都要过滤一次所
有像你这种人的记录。
现在全世界都认为中国人最有钱。 个人行为会影响全中国人的形象。 |

据媒体报道，近日美国学生与交流访问学者信息系统(SEVP)公布最新留学生数据显示，
截至今年2月，中国大陆在美国的留学生总数为331,371人，中国已经成为在美国际学生

而今年美国高校公布的本科申请结果显示，美国多所名校本科录取率再创新低。哈佛大

中国留学生在美国校园触犯“学术不诚信”案例，近三年至少增加三至四倍，美国艾克留学机构表示，三年前，10名因各种情况被学校开除或警告的中国留学生，大概只有一名涉及作弊，三年后的今天，10个被开除或警告的中国留学生，至少有三至四名是因抄袭、考试作弊、找人代上课等情况，导致求学过程发生“障碍”。

习的国际学生人数达到120万。国际学生中77%来自亚洲。而在从幼儿园到12年级(K-12)
的“小留学生”中，来自中国的占到52%。
在美国学习的持F及M签证的国际学生人数与2015年7月相比上升了13.3%，达到120
万。与此同时持J签证的访问学者人数从约24.5万下降到20.2万，下降了17.5%。获得学
生与交流访问学者项目授权的美国学校共8803所。有466,900名国际学生在STEM(科学、
技术、工程、数学)领域中学习，占120万持F或M签证的国际学生总人数的39%。

定威胁校园安全遭开除。另一名同样来自中国、就读教会高中的男学生，因到女友寄宿
家庭约会，被寄宿家庭以“私闯民宅”报警逮捕。
专门招收中国留学生赴美就读，并提供“一条龙”服务的威斯康辛国际学院，其总裁孙
建国3日表示，随着小留学生人数激增，上述真实案例经了解，其实都是因为“文化”
、“背景”差异造成。
事实上，中国小留学生已经成为美国留学生群体中增幅最大的族群，根据美国国内安全
部“学生和交流学者项目”(SEVP)统计，2010年到2015年期间，在美国公私立中小学持

your work for yourself. Guidance from SEVP says that unpaid positions still
count toward maintaining OPT status as long as the work is directly related

发帖数: 395 | 40 H1B 7月份批下来了，由于本人不在那里工作，所以很快公司律师就申请了H1B的
withdraw，但是USCIS 的Vermont Service Center效率十分低下（它家花了3个月时间
批H1,又花了3个月时间批withdraw，而通常都是两个月），直到上周，我才弄到正式的
withdraw通知。
然而，9月份的时候，SEVP已经assume我的H1即将生效，所以把SEVIS record改了，说
OPT 2011年9月30号失效。但既然现在H1B已经在7月29号withdraw了（正式文件上写的
是这个时间withdraw），所以我的OPT应该继续使用至明年一月份。学校的
international center已经同意递交申请改exp date
我的问题是，有没有大侠经历过这样的事情，SEVIS record改过来需要多久？还有就是
在SEVIS RECORD改过来之前，是否有authorization工作？现在这种情况能否申请H1或
者OPT extension？ |

（之前在版上发过，谢谢大家回复! 因为学校和律师方案不同，所以重发一次~ ）
我的F1是9月21号到期，h1b批了，10月1号生效。帮忙办h1b的律师说，对这9天gap要申
请cap-gap relief, 让找学校申请新的i 20， 标明是cap-gap relief, 确保9月30号到
期就可。但是学校说，我的program过期后有60天grace period, 不需要申请，还打电
话问了sevp(sevis下属部门），确认我不需要extend I-20。我是语言学校，无opt/cpt
。
咨询了几位外面的律师，有说depends, 有说不需要。请问大家有类似的经历么？多谢

An F-1 student who has attended an SEVP-certified college, university,
conservatory, or seminary on a full-time basis for at least one academic
year may be authorized for up to 12 months of OPT per education level.
之前MS已经毕业，没有申OPT，现在再申请一个MS毕业的时候可以申请OPT么？
因为碰到朋友说第一个学位无论申不申OPT第二个同等级的学位毕业的时候都不能再申
了。求有类似经历的朋友说说。 |

况必须在opt头12个月内完成答辩。想起之前有位仁兄提供了这个SEVP的文件：http://www.ice.gov/doclib/sevis/pdf/opt_policy_guidance_042010.pdf
在6.7说道即使不答辩也可以申请17个月的延期（May apply for the 17-month
extension if otherwise eligible，这个不知道我是不是理解的有问题）， 但在紧接
着的6.8又说道如果头12个月内不答辩的话要换身份或离境（这个跟学校iso的说法一致
）。
我的问题是，如果我不能在这头12个月内答辩的话，到底还能不能申请那17个月的延期
呢？本来不想问这个问题，不过答辩在老板那里一拖再拖，心里没底呀。。。 |

经过版里筒子一顿教训，楼主知错了。。H1B的确来之不易。。楼主也想好了，先保H1B
为重。
没想到今天又有新进展！！
新公司的HR打电话来说，他们有可能说服律师帮楼主transfer H1B！但有一个前提：无
论denial还是approval，都必须选择新公司了，i.e.，不能说transfer denial的话还
想回旧公司。
现在楼主想跟大家分享一下最近搜索到的所有关于10月之前transfer的信息。也求大家
知道的信息和input！
1. 楼主给至少15个移民律师打过电话，大概一半说可以，一半说不行。说不行的律师
大多提到了移民局最近的新规定新理解，就是10月之前的transfer不能exempt from
cap。而在2014年之前都是可以的。
2. 在所有说可以的律师里面，楼主选择了张大钦律师进行深入交谈并做了500刀的付费
