Presence Test那部分。一般超过183天在美国就满足Substantial Presence Test，就
算是resident。但是后面解释某些身份的某段时间（包括学生前五年、老师前两年、等
）是exempt的，不算在Substantial Presence Test里面。你前五年是non-resident就
是因为这个。你现在第六年不算exempt了，而且在这里超过183天了，就满足

境内转身份或者回中国一年内转身分或者从第三国居住一段时间后来美则不享受treaty。

1. F1前5年的时间是exempt from Substantial Presence Test的。所以你2014年只算
最后3个月在Substantial Presence Test，不够符合2014年的Substantial Presence
Test。所以你2014年全年是nonresident。
如果你2014年最后几个月都是在美国的话，如果你想的话，你可以选择用First-Year
Choice，变成2014年dual status。这个选择基本上只有对已婚的人有好处。已婚的人
可以跟着做另一个选择变成2014年全年resident，跟着跟配偶报Married Filing
Jointly。单身的人变成dual status基本上没有比全年nonresident有什么好处。
2. F1身份期间（10月之前）的收入可以。
3. 没有变化。无论你是H1b身份或没有身份，对于Substantial Presence Test都是一

了GC和substantial present test）
First year choice，就是说，2007或者2008年也没有满足GC或者substantial test.
并且2007年没有选择part of resident, 但是在2009年满足substantial test, 那么在
2008年就可以做part of resident
如果做First year choice, 就算是Dual-status了。
我现在的情况是2008年10月拿到H1B，但是在2009年2月被裁掉了，在2月底转成F2了
2008年有：92/3=31天
2009年有：55天
这样我就不能算作dual status，对吧，只能是NR |
