substantial number呀？我给11个journal做过review，大概有20个不同的编辑联系过
我，这样的number够吗？
另外可以提供的evidence是“service in an editorial position extended over a
substantial period of time” 或者 “reviewed articles for a journal or
conference that credits a small, elite group of referees”, 这两个感觉好难啊
感觉我都不可能符合，我没有当过期刊编辑，也没有在conference做过组委会... |

experience for jobs substantially comparable to that involved in the job
opportunity.
我认为这条法制定的出发点是限制雇主不能随意提高职位要求，让求职市场的美国员工
都不合格，只有办PERM的这个外国员工合格。实践上，这根本就不是个问题。因为可以
reasonably argue that each PERM position is unique, it is "not substantially
comparable" to any other positions within the company. 所以， 你所有的问题
都不需要被提上来。如果一定一定一定要钻这个牛角尖尖，我认为这条法律的实用应该

，加了一些修改。
(1) that my proposed endeavor has both substantial merit and national
importance;
(2) that I am well positioned to advance the proposed endeavor; and
(3) that, on balance, it would be beneficial to the United States to waive
the job offer and labor certification requirements.

我的疑惑是，substantially, voluntariness is not an issue here in this case,
since Commonwealth v. Allen provides "When the voluntariness of a defendant'
s statements to private citizens is an issue, the
judge should conduct a voir dire to determine the
voluntariness of the statements.", this case (Waters) happened before Allen,
and Allen is not retroactive, therefore voir dire is not required,
voluntariness is not determined.

话说很多美国政府干过的事情中国政府想都不敢想，比如说著名的案例Wickard v.
Filburn。Roscoe Filburn是一个老实巴交的农民，1940年他因为多收了三五斗被联邦
政府罚款（大萧条时期政府限制播种担心丰收压低粮价），Filburn大喊冤枉说自家种
的谷物都是自家用，又不在市场出售和政府何干？他一怒之下把农业部长Claude
Wickard告上法庭。
这个官司居然最后一直打到最高法院，1942年最高法院九名法官全票判该农民败诉，原
因是：如果你不种那么多小麦你就得去市场上买小麦吃。你的不作为也是影响了市场，
政府当然有权管你。这么牵强的判决一直到九十年代United States v. Lopez一案才被

马英九指出，这个法庭的存在，应该是为国际争端定纷息争、避免走上冲突甚至战争。但是，这样的仲裁结果，不但没有排难解纷，反而增加了冲突的可能。「在背後操控的势力，看似赢了面子，其实却输了裡子。」
「菲律宾对中国」南海仲裁案，常设仲裁法院今天公布结果，称中国大陆在9段线范围内主张的历史权利没有法律依据，而南沙群岛的所有海上地物，均为礁岩，包括太平岛在内。

2011年11月号刊登韓德森（Scott J. Henderson）的文章说，美国和西方对中国的观察
，通常基于政府政策的演变、外交关系、实力重组等因素，但还有另一个有用的参照物
，那就是军队的外语培训。
早在1949年，中国人民解放军就在洛阳建立了外语学院，作为培养国防语言人才的摇篮
。现在洛阳“解放军外语大学”已经培养了5万多名毕业生，担负起军事翻译、军事外
交、国际反恐、联合国维和行动等各项工作。从该校的课程设置可知，这是一所培训(
能破解密碼的)多种语言人才的军事情报学府。
解放军外语大学出版自己的《外语杂志》。1978年至1987年，以英文、俄文、日文、韩
