最近遇到个小麻烦，希望大家尽快给点意见。
LP十一月份出了点小车祸，当时她很害怕，所以记不清细节了，她记得当时换道到左边
后被后面一辆车给轻撞了一下，然后停到路边后又被撞了一下造成左后角bumper 一个
坑，对方的车好像是右前bumper刮了，老婆没经过这些事，害怕又糊涂，没仔细看对方
车哪坏了，只是感觉不严重，给保险公司CLAIM时就没提换道，但当时保险公司打电话
问她当时有没换道是她说记不清了。后来我们保险公司就赔了我们近500（买的全保）。
老婆以为这事就过去了，可谁知最近接到Surcharge NOTICE，说她要付more than 50%
的责任，给AGENT 打电话，AGENT说对方居然CLAIM 2000刀，我的保险公司和对方保险
公司meeting后，根据车的损坏情况，作出老婆付大于50% 责任的决定。（这离车祸发
生都两个月了）真不知道怎么这样，AGENT说可以appeal，老婆怕事，想问
1）对方怎么会这么长时间之后才CALIM这么多？还会不会有后续的什么CLAIM?对方是个
80岁的老头。
2）APPEAL 很麻烦吗？这种情况会有多大把握？
3）如果不APPEAL,每年保险会长多少? |

发帖数: 1106 | 5 I am not sure why everyone assumes it's the fault of LZ's wife. Changing
lane doesn't make it necessarily so. Maybe the other car was trying to
change lane too from the other side.
Did the other insurance talk to your wife too? How soon?
Also, since the damage was not big, did the two parties discuss about
getting estimates and working sth out?
Many people changed their stories after an accident.Here is an experience of mine. I appealed my case with one of the arguments being the timing of the claim filed by the other party.
I was changing lane to the left when hit behind by a car, also 左后角bumper
vs 右前bumper. I was pretty positive there was no car behind me on that lane
, but it's just my words. I suspect the car behind was changing lane to the
right, but I didn't know for sure, and that's what I told my insurance as
well as the other one.
In my case, the damage appeared little. We exchanged info and agreed to get
estimates and talk on the phone. I got a couple of estimates around $500-600 and called
her up, she then decided to go through insurance. She never gave me an
estimate.
She claimed I moved to her lane and bumped her, so my insurance thought it was my fault initially.
I appealed. I didn't dispute I did change lane, but I argued that she probably was changing lane as well, and she may be at fault since she waited to hear my estimate before filing a claim, but
never gave me one to see if I would be just willing to work with her.
My insurance company bought my argument, and ultimately ruled I am not at fault, but they were never able to get my deducible back from the other insurance company.
Looking back, did I have a strong case? I am not sure. I only have some circumstantial evidence. but you never know. |

错了。

我之前很惨的被开了一张单，实际上双方应该50%的责任算了我全责
事故有点类似，我切左lane，切之前看过左lane空的，隔一条lane后面有一辆车，没想
到我切的时候那辆车加速切右lane，该车右前撞我车左边侧面后轮胎处。
警察强调切右的车有优先权给我开了单...

friend to the airport. It didn't take us more than a few minutes before we
left the scene.
Hm, I don't know who should be more at fault if both were changing to the
middle lane from opposite sides. But wouldn't the one behind has more
responsibility since the driver has a better view and more time to take a
proper action.

老婆问agent保险公司有没有拿到警察的report，说警察没出任何statement。
想问一下楼上经过appeal的兄弟， 那很麻烦吗?
appeal后就算case结束了吗？还是可能还会有其他情况发生？
老婆怕麻烦，想早点结束。但又怕以后还会有点其他状况。 |

发帖数: 364 | 15 今天去了agent那里，本来不打算appeal，可她说我这个只是surcharge appeal,只是针
对于我的驾驶记录的，appeal的结果是不会影响这个 accident的结果了，只影响我来
年的保险会不会涨点，我的保险公司和对方的保险公司已经对这个ACCIDENT做出了判断
了。
AGENT还说我的保险公司的人，也就是刚开始给我打电话调查情况的人说“have her
appeal’,我就挺纳闷，如果APPEAL我赢了，保险公司岂不是赔钱了，因为他们已经赔
了我的近500刀，赔了对方的两千刀，又不能涨我的保险，看起来与我很有利，他们怎
么会做这种吃力不讨好的事呢？
还是会有什么其他的原因？
希望大家有过这种经历的告之一下。会不会有什么其他不利因素在里面。
