My car insurance contract does not have options as to who should be primary
pip.
I asked my medical insurance to pay the bill after my car insurance told me
that they are not obligated to pay it under my policy. However, later I
found my car insurance should pay it. Now it looks like that my car
insurance refused to pay it because my medical insurance had paid it, even
if I told my car insurance that my medical insurance had asked for
reimbursement if I settle with my car insurance.
In this case, could I ask my car insurance pay me and then, I pay my medical
insurance.

I asked the other driver' insurance company to pay the bill for a couple
times (the other driver was at fault), after the refusal of my insurance
company, and the other driver's insurance finally asked my insurance
company to pay the bill. That is how I found out that my insurance should
pay the bill.

If you are sure your PIP is a primary one, ask the adjuster why they don't
pay in a formal letter or email. Don't call, recorded call may or may not
be used as evidence at court. PIP has deductible, maybe your expense was
lower than that?
Again I still don't know if your PIP is primary or secondary. The other
driver's insurance may not know your policy detail. You have selected your
PIP coverage when buying it. Read your policy declaration page, it should
be very clear what limit and deductible your PIP is and if it's primary or
secondary.

The adjuster request that I provide "out-of-pocket" receipts in order for
her to issue payments. I asked her basis for the request. After a few
months, she only produced the following quotation:
Per Massachusetts Automobile Insurance Policy, page 5, Part 2. Personal
Injury Protection: Part A. A. Medical Expenses:
“We will pay all reasonable expenses incurred as a result of the accident
for necessary medical, surgical, X-ray and dental services. This includes
prosthetic devices. It also includes ambulance, hospital, professional
nursing and funeral services.”
After I told her that the quotation says nothing about "out-of-pocket"
receipts, she cannot provide any further basis for the request of "out-of-
pocket" receipts but just insists that she could not issue the payments
unless I provide "out-of-pocket" receipts.
Anyone has idea how to copy this adjuster or have to file lawsuit. It looks
like that the adjuster cannot justify her request and I likely win the
lawsuit.

怎么可能。人家不是说了你只要提供你付过钱的收据他们就给报销啊，如果是你保险公
司付的他们当然没必要付啊。 |
