聘的律师说EB3 的Priority Date 不可以转给EB2。但是我听说是可以的。我想再跟公
司律师谈谈，请问有没有人知道有什么信息出处或特别文件需要提交to support the
PD carry over??

As long as you get this I-140 approved, then you can carry your PD in the
same company or other companies.
Better stay with same company for 180 days after I-140 approved.
2. Apply a EB2 or a second EB3 or EB1, whatever later, your PD is yours
forever.
Do not trust your attorney. he is idiot.

But the attorney wouldn't do it if I could not find the support saying that
PD is portable between different classifications.
If you know any document that I can use to show to my attorney, that would
be very helpful!

只要你 有 批准的 I-140， 你就是 表达了这种倾向。 以后移民局都有你 I-140的
记录。 有时即使你 在申请I-140时没有要求 PD PORT， 移民局都可能 主动 给你 旧
的 PD的。
即使你 的 第二个I-140没要求 PD PORT， 申请485时都还来得及。
具体的规定的 找 GOOGLE。 PD 的 官方定义。 或你 可以问 TRACKITT。 EB3-I 干

发帖数: 1737 | 5 这个我正在办，所以很清楚。用以前的PD不是问题。关键是你能不能在本公司申请EB2.
根据规定，在本公司工作期间获得的学历或经验不能用来QUALIFY EB2.也就是说以前只
能办EB3，现在一般来讲也不太可能给你办EB2.
如果能重新办EB2的话，PERM跟以前的CASE无关，该怎么办就怎么办。recapture of
the old PD 实在办I140的时候实现的。
