be much appreciated.
My wife's F1 OPT will expire at the end of this June. I heard that there
will be 2 month "grace period" that allows F1 students to depart US or
change status after the expiration of the F1 status. For certain reasons (a
little complicated and may not be necessary to be detailed here),I want to
file the change of status for her from F1 to H4 in that grace period. I am
holding H1b visa.
But my company lawyer told me that I should change my wife's status from F1
to H4 before the F1 expiration date (that is, by June) to avoid the risk of
denial of her petition if she is deemed to have been out of status.
Can you please advise your opinion?

the reciept which should be right after uscis recieves it, you should be
fine.
do your company pay for lawyer fee? if not you can do that yourself only
cost 300, piece of cake. |

果你前面用了后面就没有了。现在不知道是不是政策变了。不明白为什么你非要冒这个险
，早转晚转有什么区别么？
前面有人说了，可以自己办，你自己可以在网上去填表试试，我记得好象有一项是开始时间什么的，你可以查一查。 |

(1) my wife got job interview and is still waiting for the results. She has
a chance of landing a job to have a H1b sponsership. I know that it is
feasible to switch F1 to H1b in the "grace period".
(2) my company is going to do the H1b extension for me this week. The
company lawyer wants to file my H1b extension and my wife change of status
at the same time. But company will not pay my wife filing and the lawyer
asked 850+290 dollars for this simple filing for my wife. I wanted to wait
for the approval of my h1b extension and do the filing for my wife later on
by myself. Note that my company will use expediate process to get my H1b
approval in 2 weeks.

发帖数: 522 | 6 原来是这样啊，你先搞清楚两个月Grace period是不是有两个月，然后你自己办吧，转
身份只要交300块好象，我建议你现在就到网上E-file的地方把那个表先看一下，看能
不能自己定起始时间。
