个1或3个月的AP。要出示证据。当场拿到一般。

Advanced Parole allows the alien to travel abroad and reenter the U.S. After

employer for whom he/she had previously been authorized to work as an H-1 or

After you use AP, you are not in H1B status but you are in AOS status. The
border office will parol you in US as a parolee (shown in your I94) and you
can work with the work permit established with your H-1 but you are not
legally in H-1B status.
However, you can still apply for H-1B visa at oversea embassy and enter US
with the H-1B visa, that way, you will get a I-94 card stating that you are
in H-1B visa.
You will need to ensure your H-1B status remain valid (for example, after 3
years, apply extension in a timly fashion). And I believe that if you apply
for extension, your status will become H-1B automatically regardless of the
I94 you have (same case as you enter US with F-1 and have I94 saying you
are F-1 and then find a job and become H-1B).

那如果用AP入境, 我就成了AOS STATUS了,一旦485被拒, 那我岂不是就不时AOS status
, 那时候,应该怎么做呢? 能在美国国内reinstat H1B吗? 还是需要出境重新签H1B?
