CP vs AOS: is CP too risky for me? PD Dec 2007 H-1 expires in March 2012
Ron,
I read your article about CP vs AOS choice and as you mentioned it is
dependent on personal circumstances. I am outlining my personal situation
here and would like to hear your opinion of whether opting for CP is too
risky for me.
My priority date is Dec 2007 and NVC says they sent me fee invoice on April
6, 2011. My I-140 was approved in Sep 2008 and currently I am on my post 6
year extension of H-1B status. My H-1B extension expires in March 2012. My
question is if I opt for CP can I still remain in US using my extension of H
-1B? also what are chances that either my priority date does not become
current in next 6 months or it does but CP processing is delayed post March
2012? if that happens do I have to leave US immediately?
