approval was categorized as EB3 and telling me the only way to fix it is to
file a new PERM/I140.
What a shit!
Please help if you know anything about this kind of situation or have any

Look at the bright side: your PD will not be impacted. You are going to wait
for it to become current anyway(unless you can charge to EB2-ROW), so you
are not losing anything significant here. |

My employer didn't give me a copy of 140, so I requested 140 forms through
FOIA.
I think your employer cheated you. What is your PD?
If USCIS made a mistake, you should correct it.
If lawyer/your employer cheated you, you can't do much about it.

I don't think lawyer/employer meant to cheat. The lawyer's email still says
they have all notes saying it is EB2. but the I-140 approval notice
indicates EB-3

You can use your PD from your EB3 I-140. It's called PD portability.

Association! Plus, the lawyer had the duty to notify you much much earlier.
I am pretty sure the lawyer violated ethics rules.

我的第一次h1b就是才给我两年两个月，莫名其妙的。后来，律师让它们改成三年了。

application. But unfortunately I already left the old company, I don't think
they will sign the 140 amendment, also the 140 was filed 4 years ago...
