Thank you for your thoughtful message regarding S.1857, the Fairness
for High-Skilled Immigrants Act. I appreciate hearing from you.
As you may know, the Immigration and Nationality Act (INA)
specifies a set of numerical limits and preference categories for immigrants
seeking admission to the United States. INA sets a numerical limit for the
number of immigrants from each country at 7% of total U.S. immigrant
admissions. These per country limits are intended to ensure the diversity of
immigrant flows by preventing the monopolization of visas by a small number
of countries. However, the American Competitiveness in the Twenty-First
Century Act of 2000 revised the INA’s numerical limits, and allows
countries to exceed the annual 7% limit for certain categories of employment
-based immigrants if some of the 140,000 employment-based visas made
available annually were unused.
I am sympathetic to concerns that these per country limits prevent some
of the best and brightest from immigrating due to their country of origin.
Potential employment-based immigrants from the countries that have the most
immigrant applicants can wait as long as ten years for their visa
applications to be approved. Clearly this system can be improved. All too
often, skilled immigrants from the countries with the most applicants end up
waiting years for their applications to be processed, even though they
could contribute greatly to our country as permanent residents.
The Fairness for High-Skilled Immigrants Act would eliminate these per
country numerical limits for employment-based immigrants. This legislation
would also increase the numerical limit for family-sponsored immigrants,
from a limit of 7% to 15%.
I am honored to serve on the Senate Judiciary Committee, which handles
issues related to immigration. If I have the opportunity to vote on the
Fairness for High-Skilled Immigrants Act or other legislation that would
change per country visa limits, I will be sure to keep your thoughts in mind.
