No you can't. Violating H1B terms are mostly the fault of employer, but
willfully giving out wrong information makes yourself part of the fraud.

发帖数: 3042 | 14 Well one needs to appreciate the seriousness of 'under penalty of perjury'
on almost every form you sign. It's not something you can lie and forget
about. If the A-San in question knew their answers are documented and could
come back haunting them in future, the chance of lying is low.
In most H1B fraud cases the employee is arguably the victim. When there is a
problem, it can be easily remedied by looking for legit job and getting a
legit H1B, which is not so hard in today's IT job market.
But lying to the USCIS investigator makes the victim a criminal. Now he
could be subject to deportation, permanent bar, even jail time. It's not a
matter of ethics but rather the weighing between risk and reward.
We tend to demonize A-San and forget that they are people like you and me.
They too have dreams and families. Even those people have no moral
whatsoever, they still need to think whether it's something worth lying.
On the other hand, it's a completely different situation for ICC. By lying
to the USCIS, they have everything to gain and little to lose.
