485 petitions. While USCIS seeks as much as possible to process immigration
applications in chronological order, processing times can vary depending on
several factors, including the return of all the required background checks
and the caseload of individual adjudicating officers. Therefore, the
situation you referenced in your letter is not uncommon and it does not mean
that there was a problem with your application or that it was misplaced or
wrongly ordered.
With regard to you and your wife’s specific I-485 petitions, they are still
pending with the USCIS Texas Service Center at this time. As you may
already be aware, the US Department of State has initiated a visa
retrogression for EB2 visa petitions for individuals from China and India.
As such, the current visa availability date has been back dated to
applications with a priority date of August 15, 2007 or earlier. The Texas
Service Center, which halted production of green cards last week, will
continue to process applications and approve them during the retrogression
period, but the alien registration (green) cards for these applicants will
not be processed until visas again become available. This will not take
place until at least the new fiscal year, which will begin on October 1,
2012. Therefore, you and your wife should receive notices from USCIS
regarding the processing of your petitions but you will not receive the
green cards until at least later this year. | D*******n
