is not under exclusion, deportation, or removal proceedings shall not be
deemed an abandonment of the application if he or she was previously granted
advance parole by the Service for such absences, and was inspected and
paroled upon returning to the United States. " - 8 CFR 245.2(a)(4)(ii)(B)
此处 previously 语焉不详，颇有争议。
上述两个难题，一直有纷争不已。现在有了答案，还是标案。
移民局在给 AILA （美国移民律师协会）的答复（见 4/2/08 Agenda）中如是说：
1) 如果 AP 在 pending 的时候离境，但是以 H-1, H-4, L-1, L-2, K-3, K-4, V-1,
V-2, or V-3 身份入境，其 AP 申请不认为是放弃；
2) 如果在 AP pending 期间离境，手中尚有未失效的 AP，且在该 AP 有效期内以 AP
入境，其 pending 的 AP 依然有效。

Previously Approved Advance Parole
The USCIS stated that if a person has an advance parole and applies for
a new advance parole while in the United States, s/he may travel and
reenter the U.S. using the already approved advance parole. The person
must return during the time period permitted under that advance parole
that was approved before the person's departure. The USCIS specified that
the person cannot remain abroad after the expiration of the first
advance parole and then seek to enter on the second one after it is
approved.
