new EB3 I-140. My attorney did it differently - he filed a new I-140 under
EB3 instead of amending the original one.

USCIS will continue to accept

that are filed with a copy of a labor certification that is expired at the
time the amended or duplicate Form I-140 petition is filed, if the original
labor certification was submitted in support of a previously filed petition
during the labor certification's validity period. These filings may occur
when:
1）A new petition is required due to a successor-in-interest employer
change;
2）The petitioning employer wishes to file a new petition subsequent to
the denial, revocation or abandonment of the previously filed petition, and
the labor certification was not invalidated due to material
misrepresentation or fraud relating to the labor certification application;
3）An amended petition is filed to request a different visa
classification than the visa classification requested in the previously
filed petition; or
4）The previously filed Form I-140 petition has been determined to have
been lost by USCIS or DOS.

prepared has no reference to any USCIS clauses. However, he confirmed that
filing multiple I-140 based on the same PERM approval is permitted (not a
grey area), although it is uncommon since EB2 always moved faster than EB3
until recently.

， though nothing has been discussed in terms of consequence of doing it.
Maybe TSC does not follow the suit.
"05/09/2006: Traditional Practice of Filing Two I-140 Petitions Based on
Same Labor Certification Under Review by USCIS HQ
Traditionally, the USCIS has been allowing the employer to file EB-2 and EB-
3 petitions using the same EB-2 labor certification approval. However, the
NSC indicates that this policy is currently reviewed by the USCIS HQ and
may
be revisited with the potential consequences of termination of its
traditional practice and policy. It is another bad news.
Pending the policy changes, NSC will request the employer to chose one I-
140
petition out of the two I-140 petitions and the second I-140 petition will
be held in abeyance until the HQ policy is fixed. Bad news after bad news.
Filing two I-140 petitions by the same employer using the two different
labor certification applications: No problem. NSC will adjudicate both. "

证明我对，而且是100%。如果能紧跟，那么你得猜测有对的可能，但依然不是100%。
