上周六换住处,搬之前将房子仔细打扫干净,没想到今天收到原房东e-mail,其"
preliminary inspection"列出多达9条待清洁和修理之处,标准严苛,照这标准没人能
做到。我刚查了一下Georgia的相关规定,这9项中大部分属于normal wear and tear,
想请大家出出意见。
我问了周围老美,均表示对这个房东不屑。我现在的看法是先找房东沟通商量,如果不
行就走法律途径。一个月房租不算太多,这样纯属被宰,但要维护自身权益。

你可以先和房东书信沟通然后去小额法庭投诉。
我有一个客人,自己管理出租房,最后不按程序处理押金。然后收到房客的投诉信. 有
法有据,掷地有声. 房东仍然不理睬。最后告上法庭,法官判房客胜,房东赔偿全部押
金加上利息。
你可以参考使用。

Dear landlord:
I am writing about the security deposit of $XXXX that I put down on the
house at XXX Dr, Atlanta GA,. Because you have not strictly adhered to the
procedures for retaining security deposits laid out in Georgia Code O.C.G.A.
§§ 44-7-30 through 44-7-36, you have forfeited any right you may have had
to retain my deposit or to claim additional damages from me. Therefore,
you must return my deposit in full by (fill in the deadline date).
In order to make any claim for physical damages to the rental unit, a
landlord must strictly follow the requirements of Georgia's Security Deposit
laws
1. The landlord must perform a move-out inspection of the premises and
provide the tenant with a list of damages and the estimated value of the
damages within 3 business days after the tenant has vacated the premises.
Within 5 business days after the tenant has moved, the tenant then has the
right to re-enter the premises to verify the accuracy of the list. I was
not provided ANY list of damages against which you were holding funds from
my security deposit.
2. If the landlord wishes to retain any or all of the tenant's deposit,
the landlord must provide the tenant with a statement giving specific
reasons for retaining the deposit and costs of any damage claimed. In
addition, any unclaimed part of the deposit must be returned with the
written statement. I was never provided any reason. Again, this was not
done in a timely manner, nor was any of what was sent back with the $200.00
refund of deposit my responsibility in accordance with the lease.
3. The landlord may not retain any part of the tenant's security deposit
for normal wear and tear of the premises. Of the items on your list, the
following either did not occur during my occupancy or amount to no more than
normal wear and tear: The brief description of the painting of the “House
and Deck-Touch up interior too”, does not justify holding $1600.00 of my
security deposit. Nowhere in the lease is exterior paint my responsibility.
The holes in the walls were all patched and painting of walls is
considered standard wear and tear.
4. The landlord must return the deposit within a month (30 days) after the
tenant vacates the premises. I received $200.00 by form of check dated
XXXX, which is 34 days past due according to the laws of the state of
Georgia.

Because you have failed in your legal obligation to follow the procedures
of the Security Deposit Law, Georgia Code provides that you have forfeited
any right you may have had to retain my security deposit or to claim
additional damages from me. To avoid further liability, you must return my
deposit in full by XXXX.
If you do not return the deposit by that date, I will file a claim against
you. Under Georgia Code Section 44-7-35, I may sue you for three times the
amount you are improperly withholding, plus attorney's fees and court costs.
I have consulted with an attorney and am aware of my legal rights and your
legal responsibilities regarding security deposits. I am ready willing
and able to take the legal action necessary to resolve this matter.

You have failed to address any of the issues in my previous email.
The reasons why you did not follow the process the law dictates is
irrelevant at this point. I had made two attempts to rectify the security
deposit after I thoroughly cleaned, moved out, and returned the keys to you
in person. The referenced laws from the State of Georgia clearly stipulate
the time you can with hold a security deposit, the methods by which you are
legally allowed to deduct against my deposit, and most importantly, the time
frame in which you must do so. You violated this, you ignored my
communications, you did not communicate why. I am a single mother of three
children, the funds that you have held in escrow, collecting interest and
improving your property that you are now selling has been sorely needed.
Your lack of communication and ignorance of the laws protecting tenants is
on your shoulders.
My intent is to file suit against you and sue you for the maximum allowable
award, plus all costs involved. Further, I will seek to put a lien on your
property which will ensure that you pay me in a timely fashion.
If you wish to offer some remedy for this before Nov. 1st, I expect this to
be done in writing. If I hear nothing, I will file on Nov. 4th and you will
be served by the court shortly after that.

多谢,这个很有帮助。
美国roommate有点面条,不太积极。我在考虑找房东一起进去看看,照相取证,如果是
“ tenant has vacated the premises. Within 5 business days after the tenant
has moved”那就要尽快了。
