发帖数: 27 | 1 I am preparing 485/131/765 application and have a question for the H1B gap (
Out of status). Here is my case summary:
1. currently H1B, first time to submit 485
2. was laid off in early 2009 (using H1B at the time). Got a job after 4
months.
3. Submitted 797 to change status from H1B to F1 2 months after the layoff,
and got RFE. Before the RFE deadline, got the current job offer and did the
H1B application (approved later on).
4. didn't leave US since 2009
5. No other status violations
My question is that would this affect my I-485 application? I did some
homework on this board and know that there is 245k section with 180 days
grace period for EB based 485 applications. Based on this, there should be
any issue - but I haven't seen any cases like mine on this board. Anyone had
any status issues but got approved because of 245k?

了，长达1年多没H1B，发现后及时出境重新签证进来（公司律师出具文件说明中间失误
），然后递交485，顺利批了EB2。 | o****t

你说的例子是通过出境消除以前的身份违例 - 我想问的是即使不出境，如果身份违例
（两份工作之间）不超过180天，是不是就不会有问题？（245k条款）
