没指望appeal能成功，最初的打算是争取一点时间以维持合法身份。
本以为在appeal期间，485会仍然处于pending状态，但昨天收到485的据信了。
485不能appeal，只能file motion to reopen/reconsider. 请问这个有用吗？
因老婆的工作合同还有10天到期，H1B的过期时间是明年二月份，但单位不想给她申请
H1延期，要求她用现在的EAD卡工作。
恳请各位兄弟姐妹给点建议，非常感谢！ |

H1 is still supposedly to be valid till next Feb. But without a job, I don'
t know how that H1 will be.
Try to convince them to renew the H1 or find a new job ba. Bless!

发帖数: 1281 | 4 你现在横竖EAD是保不住了，除非你的140appeal能成功。与其想办法保住485，还不如
用这个作为借口让单位给延期H1，就说没有EAD了。如果单位不给延，工作结束后转成
你的配偶身份，也比用EAD强啊。一旦EAD用了，就失去现在的移民身份了，140，485彻
底被拒后就只能回国了，然后在国内激活身份，只能签H1或者H4过来。我的理解阿。 |

EAD还没有用过，本来她新合同从11/25开始（需要EAD），现在看来只好放弃了。
如果转成H4身份，假定有新的EAD（重新递一次EB1A)，是否用了EAD后H4自动失效？ |

perfectly fine now.
Don't tell her employer about the denial of 485 and get the contract renewal
first. If you are pretty certain her company won't renew her H1B, it's
probably a good idea to start looking for a new job. |
