we are waiting for the denial notice to figure out if it is worth appealing
or just drop the case. Need some advice from experienced people on the board

which runs out the end of next March. My lawyer told me to file an O-1 ASAP
as a backup. I wonder if I can still trust him, since he didn't seem to
work hard enough on my case. I just asked him to file NIW now since it seems
moving a lot faster than before. |

If you want to get an EAD out of this green card though, you'll have to file
it again ASAP and concurrently (140+485) so that it's possible that you can
get the EAD by March.

strong case, that is why my lawyer suggested EB-1b:
Ph.d Environmental engineering 2009 (top 3 university) since I have a very
broad research background, I filed it in the field of Chemical Engineering (
my undergrad major)
Paper: 5 (all first author, English journal)
conference posters: 8
citations: ~ 30
Review: 6 (three different journals)
Working in a small biotech company now.
We claim: judge of others work, scientific contribution and authorship
RFE: judge and authorship met, not scientific contribution. but also not
recognized internationally as outstanding researcher.
When we addressed RFE, we only claimed the two that were met. And we got two
more independent references, and two letters from chief editors of two
journals,two NewRX reports, and another letter from my ph.d adviser that the
technologies I worked on in grad school was licensed by another company.
The lawyer suspected that the problem came from international recognition.
And he said that my work was good, and my PI was well known, but I am not,
so it is hard to draw the connection. |

since we only need two for EB1-B. I was confused as well, but I decided to
trust him since we ran out of time. He really waited till the last minute to
send out my RFE...:(

For initial application: I have two independent references from FDA, and one
from a US medical school, and plus three from my grad school.
For the RFE, I got another one from NASA, and one from non-profit research
organization.
How important are the independent references from overseas? For some reason
he doesn't think the references are that important.

They sort of did a google map citation map to show that I have citations
from 10 different countries. And they thought that was good enough.

IO who gave me RFE is EX0002. But not sure if he was the one who denied it
since we haven't received the denial letter yet. And my lawyer said that he
needs to read that letter careful to decide if it is worth appealing

好像很多人担心 NSC 难一些，我也只是看到大家这么议论的。
不过你被拒会不是是因为你三年工作经历不够啊？之前看到一个被拒的例子（http://www.mitbbs.com/article/Immigration/31983459_3.html），denial letter 和 RFE 毫不相干。

Contribution and international recognition are the criteria that MUST be met
for EB1B. Other claims are used to support these two.
Get some international independent recommenders to support "international"
recognition.
Contribution criterion should be fully addressed as well.
You can file your case as soon as possible once you have addressed these two
issues.
It is said TSC is easier. So E-file+pp might help you to get to that center.
