Today, my HR gave me the denial letter. Two merits met, (contribution and
scholarly articles). But Totality is not met.
The IO commented like:"
Outstanding researchers should also stand apart in the academic community
through eminence and distinction based on international recognition.
.....
While these letters show that the beneficiary is recognized internationally,
they do not demonstrate that he si recognized internationlly AS AN
OUTSTANDING RESEARCHER. The evidence does not show the beneficiary is, as an
individual, an internationally -recognized outstanding researcher compared
to all others in the academic field."
This is what I failed to do indeed. I did not say that "I am the best" any
where. In my RL and PL I tried hard to explain that I did some outstanding researh, which is not enough for my case.
It has been a terrible week for me. HR said the company lawyer do not want
to refile EB-1b for me anymore, they only want to file perm for me.
Is NIW faster than PERM? Should I file NIW by myself? | F***a

还真是totality没过，和偶在你上个帖子里预测的一致，不过IO这么明确的提出来是
outstanding的问题，而你又认可这点你没组织好，我觉得事情还有挽救的余地：
1.如果你能找到新的硬件，诸如你又发了新文章，或者新patent，或者任何新的证据能
证明你是outstanding的，是above all others的，不妨试图先说服HR和律师，re-open
你的case，如果你的证据足够强，组织的足够好，还是有可能翻案的。（file a motion to reopen or reconsider with this office, you may do so within 30 days from the date of this notice.）
2.如果没有什么足够强的新证据，re-open也很难翻案的，那你能不能去搜集足够多的
新证据，自己重新组织材料，将1B的case当作1A来准备，将这些新旧材料重新包装，试
试去说服律师:这些新证据新包装，已经足够证明你是small percentage，above all
others,当然就是outstanding了；让他有信心帮你再递个全新的EB1B,而不仅仅只是
refile个旧package(如果只是refile个旧的package，我是律师我也会觉得纯粹是在浪
费时间金钱）。
单位能支持EB1B，这机会实在不该错过，特别是在这水龙年，连我这弱你很多的case都
能被批准，你还有啥好担心的？将1B的case按1A的标准去努力准备好，自己重新包装，
去说服律师说服HR,个人觉得还是很值得一试的，这点努力和perm/NIW的等待相比，应
该很值得吧，公司已经支持过你一次了，应该还是很有希望说服他们的。

可以 MOTION TO REOPEN 么？
plus,in my contribution criteria, IO只提到了我的一方面工作，很多其他工作都没

the top in the field, as the IO requested. All 数据 are for that conclusion,
and mention this conclusion explicitly.
It does not matter whether your evidence is for this contribution claim or
not, all the evidence is ultimately for totality.
What's your background? If you want to go for EB1A or NIW using a lawyer
that you choose or DIY, you don't need sponsorship from your company at all.
EB1A might be faster than all other ways.

especially with the record of Eb1-b denial.
However, Eb1-b should be worth to give another try .
Today, HR told me if you really want to give another shot, they allow the

发帖数: 6523 | 14 It's great that your company is willing to refile EB1B. This payment is no big deal. You don't even need a lawyer this time. See the templates free download at the top of this board.
You can do this immediately. Well, before that, do spend time to rewrite the PL very well, to state how outstanding and internationally influential your research is, and maybe get a couple of new letters with such words.
