The application will be filed under DOL’s PERM regulations. This program,
which was initiated in March 2005, is currently taking 4 to 6 months for
processing. Note, however, that DOL has the option of auditing cases
through either a random selection or on a case specific issue. In the even
of an audit, case processing can take up to an additional 8 to 12 months.
DOL has no specific time frame in the regulations in which these audits must
be completed. Should Kopin Corporation's case come up for audit, we will
certainly contact you to provide updates on anticipated processing time.
