本人I485 current了（EB1 140 批了），但是还没提交。现在准备回国结婚。想向各位
咨询一下，结婚后，老婆可以持有B2签证（因为她最近刚刚来过美国，签证有效期还有
大半年），直接过来和我一起递交485吗？还是最好让他换成H4过来在一起提交485？希
望各位能分享一下类似的经历。

During AOS, your wife has to keep her valid visa. If you can get I-485
approved within her valid visa period, then it should be fine.It takes 7
months at TSC approximately except some lucky cases. Which center for you?
If not, H-4 would be safer.

status. After she get AP/EAD, she can even travel to china and come back
and work legally in US. I don't see why you think it depends.

发帖数: 753 | 6 How about H-4? Remember, after 485 is received, the applicant is in the AOS
status. He can still use his valid H-1B to work (thus doesn't have to use
EAD) but he is not on H-1B. If he travels out of US and apply H-1B visa
again, he will be back on H-1B status.
