那这个F1出境后入境时用了AP，是不是还是保持F1但是I20的时间一到就不再是F1身份
，而是AOS了？还是可以合法呆着的。
F1也可以用EAD寻找工作机会。如果I20到期了，也可以使用EAD工作吗？

发帖数: 1322 | 2 Whenver you use 485-EAD or AP or your current immigration status expires,
you become AOS.
If you enter with AP, you will become AOS even if your F-1 has not expire.
In fact, your F-1 will automatically expire when you use your AP.
You can use EAD to work any time with any employer you want. But whenever
you use it, your F-1 status automatically expires.

2.持F1出境（虽然有EAD和AP）,可以继续申请F1 visa而不是使用AP吗？

需要去国际学生办公室说明吗？
Yes; but it does no real harm if you do not.
Yes; however, your F1 visa application may be denied because you have
immigration intention. Well, this is not an intention anymore, you are
actually doing the immigration process!
Remember that if you apply for any non-immigration visa after GC is issued,
GC will be invalidated. That is how 马英九's GC is invalidated. Make sure
you apply for F-1 only before 485 is approved.
If you used EAD, then H1b is invalidated.
If you use AP, the situation is complicated because the law is not clear
about that.
However the consensus is that after using AP as H1b holder
(1) your status will change from h1b to AOS. you will have an I-94 stamped
with AOS or parolee, but not h1b
(2) However if you come back to the US with AP then work with the same h1b
employer, then even you do not inform your employer your usage of AP (which
effectively means that you lose your h1b), USCIS does NOT consider that you
are working illegally.
(3) Although the h1b actually is non-exist (you are now AOS), but you can
still do usual h1b transfer and extension, AS IF YOU HAVE A VALID H1B.
Anyhow, your status will be AOS, which means that if 485 got denied, you
must leave the US immediately.
