The information given to me in your email indicates that you are eligible
for green card application through national interest waiver (NIW Eb-2) now
and possibly through Eb-1A.
I. NIW
NIW is a special classification for Employment Based Second Preference (Eb-2
) that requires either advanced degree or exceptional ability. With a Ph.D.
degree on hand, you have a prima facie case for Eb-2. Moreover, in NIW
petition, a permanent job offer is waived. You do not need U.S. employer's
sponsorship.
To qualify for a national interest waiver, you need to prove, among other
things, that your past achievements justify the projection that you will
contribute to the U.S. national interest at a substantially greater degree
than U.S. researchers with comparable backgrounds. This is the key to
success in an NIW petition. Your resume indicates that you possess the
academic credentials that many successful NIW petitioners do, for instance,
peer-reviewed publications, citations to your work by other researchers, and
research experience in an area that will benefit the U.S. national interest
, etc.
Among the credentials, your citation record with an aggregate total of 65
independent citations to your English work is particularly helpful. In NIW
petition, citation record serves as substantive evidence of the impact of
your work on the field. In addition to the citations, you will also need to
submit independent recommendation letters to further prove your influence on
the field. Independent letters are from experts who do not know you
personally or who have never collaborated with you but rather are familiar
with your work through your publications.
Overall, your credentials indicate that you are eligible to file NIW
petition with an excellent chance to be approved under normal circumstances.
II. Eb-1A
Like NIW, EB-1A does not need employer's sponsorship.
To qualify for Eb-1A, you need to meet at least 3 out of the 10 criteria set
for this classification. Your credentials have the potential to support the
criteria of 1) original contribution of major significance, 2) authorship
of peer-reviewed publications, and 3) participation as a judge of the work
of others.
Having determined that your credentials potentially meet the regulatory
criteria, we need to evaluate how much weight the evidence carries for each
criterion. Based on your publication and citation record, arguments can be
made for criteria 1 and 2. But the independent citations are on the lower
side of USCIS approved EB-1A cases. At the same time, your reviewer work
provides reasonable evidence for criterion 3.
Assuming criteria 1 – 3 can be well documented, this EB-1A case should have
a fair chance to be approved, but it is also under substantial risk to be
denied by USCIS due to moderate independent citations.
I hope this evaluation will help you better understand your case. For your

我也知道引用有点低。但我真不愿意等NIW排几年,所以,能不能如果这次单独试Eb1a,
失败了后等引用上去了后再二进宫呢,就用这一次律师的整理的资料update 一下行不?
