有把握。这种情况下适合concurrent filling吗？是不是I140不被据，最终通过，
concurrent filing就没有白折腾？EAD卡能在提交concurrent filing的情况下提交申
请么？
ld现在在国内，这种情况下能concurrent filing吗？过来的朋友请指点。多谢。 |

has given me a lot of opportunities that is unavailable otherwise. Merry
christmas and happy new year!

发帖数: 735 | 11 Thanks buddy. This is actually the part that gets really tricky. She is
under h4 now. If we file concurrently while she is here and before EAD and
AP is approved she leaves the US (flight tickets already purchased, and we
are considering whether to do this way or not), what is gonna happen to the
EAD and AP? Is the EAD/AP application automatically gonna be waived? It
looks to me that her 485 will be fine because she is on H visa (not that
sure either, because all the websites talk about h1b explicitly, not H4). I
also find out that she can file a consular processing back in China, but
looks like to do that my I140 should be approved first, which means we
should not consider concurrent filing at all.
Another complication question, my current job is gonna end in June, which
means it is highly possible that by that time this whole 140/485 process is
not finished yet. Worst case scenario, what if she starts using EAD let's
say in May and our concurrently filed 140 is rejected? In my understanding I
can transfer to another H1B and will be just fine. What about her situation
? Will her H4 status be automatically carried over because my H1b is
renewed and even if her 485 is rejected? Her H1b visa expires in September.
Will it carry over when I transfer h1b or does she need to apply for a new
one?
Let me know what you think. It's a delicate situation indeed. I kinda start
enjoying it just for the sake of reasoning… Merry Christmas and Happy New
